When I was introduced to the terms and conditions of using United Bank Card as my merchant processor at a trade show presentation, their representative had said as part of a large group and I was offered special rates and conditions. One of the conditions was that we were on month to month with no long term contract.
I called to close my account with United Bank Card and have been told there is a 3 year contract in force with early termination fees of $250 if I close prior to August 12, 2012. I contact the rep who confirmed I was not supposed to be under a long term contract but who explained he was no longer my sales rep and does not have any paperwork.
The rep contacted United bank card on my behalf and was told I am under a 3 year contract. As their rep, as their agent, he represents them. He says he had the authority to offer the month to month but somehow doesn't have the authority to do anything.
I have been emailing the rep and he in fact does maintain he told me there was no contract and no early termination fees. Evidently he forgot to write it on the contract after signing it but before faxing it into them.
I requested that they terminate my contract and release me from the early termination fees which should not apply to me but they have declined.
Furthermore, the original fees in place at the time I began with UBC have been increasing dramatically. First there is a new $27.95 fee three times a year. Then there is a new $89 fee annually. (PS Although I had no minimum on my contract, a year ago they started charging me a minimum. After many phonecalls, I did get that resolved. I guess they hoped I wouldn't notice!)
Finally, the third page of the contract is not the one I initialed, and the initials on that page are not mine. They have threatened that if I proceed with claiming a fraudulent contract, they will reverse and refund all the transactions on my account for the past 2 and a half years!
