Hawley Transport Services Incorporated gave falts info on my dac report and told me to tell comp doctor i fell at home and not at work Greeneville Tennessee
I started with Hawley transport who are based out of newport tn back in 2008 i thought they were a nice family just him and his wife.
In april 08 i fell off the back of his trailer and injured my back,i returned home and told hawley reid that im going to the dr office,he said tell them you fell at home and,not at work and that he would take care of me,i didnt and filed workmans comp.He drove around were i lived to see if i was working,or doing anything which was against workmans comp,he would sit at the top of my street and watch my home.When i was released from the doctors i went back to the company i left to go to hawleys,i was there two weeks when hawley phoned them and said that i was on workmans comp and should not be driving,i proved that i was not, but was fired because i never told them i was on it prior to returning to them.Hawley put on my dac that i had two accidents,this is untrue a trailer wheel slipped off the customers sidewalk because the embankment caved in i had to get a tow truck to pull me out,the other was a 90 degree back into a dock with cars all around the backing was hard had no spotter and the trailer corner hit the truck back side wind reflector and creased it a little.Hawley made a big deal out of both and he never gave up on it.Since i left hawleys i have found it hard to get back into trucking because of what he has said and done to my dac report.

Read my rebuttal to Mr. McCandless, Mr. McCandless is a pathological liar.
Mr. McCandless went to Tacoma Hospital asking for treatment before notifying Hawley Transport
about his alleged injury. All workman's comp. claims must first be reported to employer as a matter of policy before claimant can request treatment! Mr. McCandless did not report the alledged injury at the time of the incident. Hawley Transport would then have the opportunity to request claimant to seek
medical attention immediatly he needed. Hawley Transport would then have had the opportunity to take statements form Mr. McCandless and others present at time of alledged injury as customary in these cases. Mr. McCandless did none of this.
Recommendation, know all the facts before passing judgement.

Michael McCandless the complainant suspiciously neglected to leave out his name, he is also being deceitful by leaving out a mountain of detail on his behalf to avoid self incrimination!. 1st. - Mr. McCandless worked for Hawley Transport on two separate occasions. So he obviously found us a suitable employer. The only problem our small company admittedly suffers from is that we try and help to many people and get taken advantage of. We should never have rehired him!
During Mr. McCandless second time under our employment he neglected to tell us that he was still technically under employment with Colonial Transport out of Knoxville, TN. by being on a temporary leave of absence. While employed with Colonial Transport, Mr. McCandless tried to report a workman's comp. claim against the company.
Representatives from Colonial Transport state Mr. McCandless made claims he was injured while at home and off duty thus not qualified to be covered under employers (Colonials) workmans comp. policy resulting in denial of claim. The dates of employment from both Colonial and Hawley will prove Mr. McCandless then contacted Hawley Transport to apply for re-employment and was accepted and shortly there after reported an alleged injury, submitted another claim only this time against Hawley's workmans comp. policy for the similar injury. This can be proven by reviewing the hiring documents / log sheets / and writeups by Colonial Transport and those of Hawley Transport. During our investigation of this claim numerous phone conversations took place between Colonial Transport / Takoma Regional Hospital and Watauga Orthopaedics about Mr. McCandless. It was discovered that Mr. McCandless previously requested treatment for a back injury sustained by a fall during the time he was employed by Colonial Transport and sought treatment from Takoma Hospital and reported to them that Colonial Transport would be covering all costs of the treatments under their (Colonials) workman's comp policy but the claim was denied. Mr. McCandless did recieve treatment covered by Hawley's workmans comp. policy though highly disputed by Hawley without success. Hawley strongly requested that legal action be taken against Mr. McCandless unfortunately Hawleys Insurance Company felt it would be cheaper to pay the claim then fight it out in court. Hawley then contacted the legal authorities at the prosecutors office in Greene County. Prosecutors were open to taking the case if the insurance company would file charges, the Insurance Company unfortunatly did not file charges. At this time Hawley has canceled its policy with this company and has taken policies with another insurer that won't back down from a court battle involving fraud by the employee.
Last but not least Mr. McCandless has also referred to negative references about himself on his "DAC Report". These reports are submitted by over 90% of the trucking companies in North America. Like a credit bureau report all employment information either Negative or Positive is reported to "DAC" for references for interested parties like Insurance Company and Employers who may be interested in said party and will base their decisions on said material. All negative claims can be disputed. Claims reported by Hawley have never been disputed and can be proven beyond a reasonable doubt.
Mr. McCandless should be ashamed of himself for all statement posted on the site and if he has any proof then he needs to step forward and present his case. We will seek council on this matter.

Have you pulled your DAC report for yourself? You can do so and make a reply to any information on there. I would do so right away.
I also would have walked as soon as he suggested that you say "you fell at home". That is illegal and unethical, and says quite a bit about the man. That is all it would have taken for me to walk right out the door.
