Hayt, Hayt and Landau Jason Dragutsky Sued us on a vacated Citi claim Miami Florida
We were sued by Citi on a credit card. They vacated the claim and wrote it off. A year later we got a notice to appear on LABOR DAY, a legal holiday, courts are closed. I emailed the lawyers and the judge. I left phone messages. No response. Now they got a summary judgement. Now we have to appeal.

No debt is actually written off unless you are given paperwork to that effect. If they SAID it was forgiven and you recieved no paperwork then the debt is still "active". It just means Citi was not able to get you to pay what you legal owed. This is still YOUR debt. Citi probably took the debt off thier books and sold the debt to a collection agency. This way Citi still gets the money owed and another company gets to take a shot at collecting what you owe. If they recieved a judgment against you, that means two things. One your debt is still legal and two there was enough evidence to show that not only could you have paid it but should have paid it.
Its unfortunate but a debt is still a debt. If you procrastinate in paying it they will just keep tacking on interest. Then one day you have a sherriff at your door informing you that you have to leave your home because a lien was placed on it. Trust me, there is nothing as bad as that happening. I would suggest you try and work with Citi and see if you can pay in instalments and maybe get this off your credit report.
