To whom it may concern:


I'm a Treasurer of Winding River Association. Our Management Company is Heritage Property Management Services, Inc. located

8735 Dunwoody Place, AtlantaGA, 30350
. The reason I'm writing to you I urgently need your help. Some checks, Heritage Property Management force me to sign (because I'm a Treasurer for our community), have no supporting documents or job was not performed at all. When I'm asked for explanation, the answer was: "You not supposed to verify just sign check".


When I start to research accounting books back to 1999, I start getting threatening phone calls.


 


Let me give you just three examples out of dozens of the same nature:


1)     For some reason Gavin Cobb (President of Heritage Management Services, Inc.) is paying our water bills from his credit card on the monthly basis, and Association reimburse him that money later. The point is that reimbursement amount significantly exceed water Company bill amount. Example: In April. 2003 Association paid to Gavin Cobb $21,184.00, but according to financial statement Gavin paid to the company only $16,172.00. The different of $5,012.00 has no supporting documents. When I asked Gavin, who authorized him to pay water bills received by Association, his answer was:" I've got that permission from the God".


2)       $9,000 association's money were spend for business cards to...Bell South, but I was unable to find any supporting documents and nobody can give any explanations.


3)       As well as where are no supporting documents for $10K Settlement to Ray Engineering Company. Interesting thing is that we are paying to this company very often, but we do not know for what? It's still a question.


4)       Most of our payments go to Heritage Maintenance Co, - a subsidiary company of Heritage Management Co. for very doubtful work. We paid and are still paying to


their subcontractors big amounts for shoddy work, They did not show me invoices from that company or any supporting documents. They spent over $600.000 for replacement of roofs and gutters in 1999 (this work overpaid at least twice) without warranty. And we had to pay to fix the roofs and gutters in 2000 for over $6,000. We are still paying even more. As I know, any roofing company should give at list 10 years warranty. That amount (over $600,000) was special assessment not only for roofs, but for renovation of parking lots and outside storage, as they promised. Owners paid $5,00048,000 in addition to monthly fee. Some owners could not pay in time and paid later after renovation. In accordance with a Bank monthly statements we collected over $300,000 and that money gradually disappeared.


 


My concern is that: 1) for some huge amounts there is no supporting documents. 2) Heritage Management Co. strongly resists to give any explanation, though I have a right to get an answer regarding origin of any expense item; 3) Heritage force me to sign checks, based on fake invoices and/or for job that was done partially or was not done at all. When I mentioned that, the answer was: "I don't care about your money, I care about


my business".



 


But the most I worry about is that after I start a research, I received a threatening phone call to kill me. Another Board member Nikki Tehrani, who wrote to the community a letter with facts, also was threatened by President of Heritage Management Gavin Cobb on the Annual meeting.


 


Members of our Association are paying pretty high Association fee around $250 per unit (we collect $700,000 a year), but the only it covers -- outside insurance, landscaping and garbage removal. After this we have a negative balance and still accumulate a debt. In addition 2 years ago every owner started to pay for water ($50-$80). Before the water was included in association fee. We have a pool, but the pool is out of order for many years and the value of our property continuously downgrading.

Please help us to find out where our money actually goes. I believe that where is a reason I start getting threatening phone calls. Two Board members collaborate with the Management Company, they have collusion to extract our money from our pockets and place, it to theirs. .Now they do everything to remove treasurer's position and they strictly prohibited me to come to  Heritage Property Management office and even to call. them..    


 


                                             


 


 


 


Thank you in advance for your understanding and help.  From December 2001 Gavin Cobb (president Heritage Property Management)  has started to pay our water bills by his corporate credit card. After 5-7 days we reimburse his payment, but amount of reimbursement exceeded payments to United Water Company. Here is a table of payments.
