I'm in the position of having been blackballed and have experienced Hireright's dark secret. Even though the FCRA gives us "protection".. Hireright has to date responded to my attempts at disputing their files by:
1. Refusing to update my dispute case untill the 30day time limit their obligated to follow.
2. They ignored my requests for an update untill I threatened to sue based on the fcra.
3. They then "LOST" my dispute report and every document I have proving my case.
4. When the "lost" information was explained, they advised me to REDISPUTE... And kept "losing" my case info not once.. but FOUR TIMES.
5. When I filed a formal complaint with the FTC, they finally returned my calls. Then, I got a reply stating that they asked and that the company I worked for "confirmed their report as being the truth"... THAT was their investigation.
6. They again agreed to 're-investigate" my case when I pointed out that they were in violation of federal law and were negligent in their half-baked investigation.
Hireright KNOWS that to remove false data will cause a vindictive company to no longer pay for their service. Such companies pay to be able to 'get even' with people who quit. Hireright avoids their legal obligations to protect consumers by delay tactics. WHY? They're counting on the fact that a blackballed trucker is NONHIRABLE. The long delays in disputes are designed to force a driver to give up and go flip burgers.
Can someone help? Is there a class action suit I can join? I've worked in trucking for seven years and, till now have a good work history. But because I picked a horror company to work for, I've now had my character defamed and my reputation trashed. I've been fighting to get justice for FIVE months. By now, I've been unemployed for so long, that my "shelf-life" is another NO-HIRE factor.
