I ordered 9 tons of river rock from Holliday sand and gravel to be delivered to my home on May 16 2007. I came home that day to find the rock in my driveway and my basketball goal bent in a clockwise manner. The goal is a heavy-duty in ground steel unit with a nice clear plexi-glass back board. I called Holliday Sand several times and they kept telling me I had to contact the delivery driver because they were not responsible. No one would give me the driver's name or contact info. DO NOT order from this company because they employ irresponsible driver's who will damage property and blow it off. The basketball goal is beyond repair and I now have to pay another company to rip this one out and install another.

Thanks Holliday Sand, I hope you get sued.

Rebuttal for Holliday Sand and Gravel

There will always be those out there that want something for nothing and you are a great example of that.

First of all, you did not discover the damage you are claiming until almost a week after the rock was delivered. If a 2007 Kenworth W900L dump truck had hit it you would have noticed the damage immediately as it would have been on the ground or broken to bits.

Second of all, not only did Holliday Sand & Gravel immediately give you the delivery driver's name but also our phone numbers. Holliday was very much correct in telling you they were not responsible as we are the subcontractor and carry our own liability. You and I had several conversations about the alleged damage to your basketball goal. If you'd list I'll post your name and phone #.

After you demanded almost $1000 to replace the unit I drove to your home and took photos for our insurance company. I have date-stamped photos of your goal, taken the day after we spoke the first time, that show no physical damage to the goal. The backboard did appear to be a bit off kilter from the pole. If you'd like me to post them I will.

Believe me if a 26,000 pound truck with 9 tons of rock on it touched your basketball goal, it would be demolished! However, there wasn't even a scratch on it or our truck.

You refused to consider pushing it back a couple of inches to square up it's position but insisted on almost $1000 to replace the entire unit. I called the Sporting Goods store you said you have gotten your appraisal from and found your were shooting me an estimate almost $400 over the actual cost of the goal. What was that for, the new hole and concrete?

Our insurance company denied the claim, and so did we, as there was no proof that our truck caused the damage. Someone hanging on the goal or the wind might have been the culprit. Typically in a situation like this we would offer some renumeration to help you even though we are not culpable, but there is no way we would allow you to gouge us. Turn it into your insurance company and see what they tell you!

It's people like you that drive up the cost of insurance for all of us by trying to defraud the system with overblown claims of damage.

Furthermore, if you insist on posting false statements about us or Holliday Sand and Gravel we do have the where-with-all to take you to court for libel.

Your truly,
