Home Benefits Services deceived me with lies and charged 298.00 on my checking account West Lebanon New Hampshire

On November 13th, 2.003 I received a call from 866-342-5619/appears 555-555-1234 on caller id, the lady identified herself as Vanessa from Home Benefits Service and she said:

Vanessa: I'm calling in regard of your VISA Credit card Mr. Sergio
Sergio: What VISA Credit Card?
Vanessa: You had been approved for a U$ 2500.00 VISA credit card with 8.5% APR and no annual fees.
Sergio: You mean I had been pre-approved, right?
Vanessa: No, you're already approved, there's no further steps. The only thing you need to do to activate your card is to pay the U$ 298.00 activation fee, I understand you have a checking account.
Sergio: U$ 98.00! Just in activation fee? How much am I going to pay for annuity?
Vanessa: It's U$ 298.00, and there's no annuity on your card.
Sergio: U$ 298.00, that's to much for activation, I was expecting something around fifties.
Vanessa: Mr. Sergio, you should consider this offer since that's a very good card and your credit is not that good, plus there's no annuity and no hidden charges ever. Imagine if u get a card with U$ 50.00 annuity, in 3 years you'll have paid more than U$ 298.00 and will keep going on.
Sergio: Yeah, that's OK, you can send the card.
Vanessa: OK, I need your checking account number and the routing number to charge the U$ 298.00.
Sergio: Why don't you subtract it from my U$ 2500.00 credit?
Vanessa: We use to do like that, but we start getting a lot of problems, so now they ask it to be charged on a checking account. I can schedule it to come up on your account any day you wish, but the credit card will only be sent 10 days after the money is charged, so the earliest you do it the better.
Sergio: OK, you can do it for tomorrow then...>

Than we got into a recording with a third party, and on that recording I clearly stated that I was paying for Activation Fee on a U$2500.00 VISA Credit Card, as their representative told me.

On November 14th, 2.003 I was charged U$ 298.00 on my checking account, and the VISA Credit card, already approved, with U$ 2500.00 credit limit, 8.5% APR and no annual fee, never came. Instead I got a letter dated December 1st, 2003 and a little box dated December 3rd, but they arrived only on the 15th, inside both them, a lot of junk mail, and no VISA card at all. A Merchandise card worthless and phone number of a list of the worst banks ever, like First Premier Bank, etc.

On the box of junk, the first thing inside is a letter saying that;

"Your Mastercard has been ordered and you'll be receiving it within 25 business days of receiving this letter. Please make sure to keep your eyes open for this to arrive in the mail.......
....please fill out and sign the aplication enclosed and send it back as soon as possible so that we can process your card. If you cancel within ten (10) business day period, the entire payment made by you, less the non-refundable S&H charges of 49.99 will be returned after receipt by HBS of your returned package."

Well, the letter and box arrived over 10 days from the date.. and there's no dated stamps from the mail company proving it; it was a Visa Credit card now they say Mastercard, and aplication for what if they're saying it was already ordered, then I saw the aplication for a "PayCard" .."This is NOT A CREDIT CARD and has no credit limit. Instead, your spending limit will be $2500......you may only make purchases or withdrawals up to the total amount of cash funds deposited by your employer onto your card account." Simplifying a card even worse than a secured card.
I tried 4 times to get the money back through their Costumer Service and now I sent a letter to the company directly, the return receipt was signed on the 02/03/04. I'm waiting a couple weeks before trying further steps.. I'm thinking about taking then to some people's court.. or try the book Rip-off revenge.

I sent a letter registered and with return receipt to them and on 02/09/04 (6 days after they get it) the money was back on my account:) here's a copy of the letter:

TO HOME BENEFITS SERVICE,

After trying four times to get my money back trough your Customer Service I found them of no use and I will deal with your office directly on this last attempt to settle these matter without a need of a legal action.

On November 13th,....

On November 14th, 2.003 I was charged U$ 298.00 on my checking account, and the VISA Credit card, already approved, with U$ 2500.00 credit limit, 8.5% APR and no annual fee, never came. Instead I got a letter dated December 1st, 2003 and a little box dated December 3rd, inside both them, a lot of junk mail, and no VISA card at all. I was clearly deceived by your sales team and this is a country based on laws, at this point there's two possibilities, you may act like a decent and honest businessman/ businesswoman and deposit the money back into my account or I'll file a legal procedure against you and on that I'll add the costs of my lawyer at least.

I'm sending this letter registered on 01/30/04 and I'll wait 15(fifteen) days after you get the letter, if I don't get my money or the exact credit card proposed U$ 2500.00, 8.5% APR, no annual fees and no hidden charges until there; we'll meet in court.
