What a bunch of scumbags. They decided to sell our home that we are under contract to buy to someone else so they could make more money. Jerry Stevens who is the owner of HBNC is one of the most deceitful and manipulative people I’ve ever met along with his puppet Sara. Do not be deceived as we were. They work hand in hand together.

We are in the process of filing a $500,000 lawsuit against these scumbags along with Remax Elite in Jacksonville, NC and Huntley Bodden who is the current homeowner. They think we are too stupid to know the law but they are sorely mistaken. They have harassed and bullied us so badly it has led to the hospitalization of my daughter and my wife losing her hair from stress; all confirmed by doctors and in writing.

They have lied, committed fraud as well as breached our contracts not to mention retaliated against us when we held them accountable to our contracts when our home was damaged from Hurricane Florence. Sara who is a representative of HBNC I consider an even bigger scumbag because she plays innocent while playing the puppeteer for her boss Jerry.

The egregiousness of their actions and behaviors is nearly uncomprehencable. They think they are too big to be held accountable to NC law. In their words "we don’t care about you. We care about making money.” Well if that’s all you care about I’m going to take as much away from them as possible. I have every right to demand what we are suing for. They have bullied us from day one. They even conspired with Remax Elite to fraud us out of our contracts and hold up our contracts to force them to expire.

They deliberately refused to repair our home after the hurricane and now sold our home out from underneath of us. We have "First Rights to Refusal” according to NC law and they think we don’t know it. They think they can bully us out of buying our home and it’s not going to happen. These people are evil and wicked in my opinion. They are indeed liars. They even sent us emails stating they were still going to sell us the house but they were breaking our contracts because they were afraid we were going to sue them.

I said they were right. We would sue them. By NC law we have the right to exercise our contractual rights without fear of retaliation. Our contracts and NC law protects us from this very thing and I refuse to let them get away with this! Well they screwed up and I’m going to prosecute them to the fullest extent of the law. Remax Elite are thieves and even stole the locks on my house even after a magistrate said it’s still our home as well.

I’m contacting the BBB, the Board of Realtors, Consumer protection and many many many other places. This company should be put out of business in my opinion. Remax Elite’s employee "Mandy” was even caught red handed committing perjury in court to the magistrate several times. I exposed that liar red handed and in retaliation they all have done everything in their power to bully us out of our home. Emily who also works for Remax Elite tried to illegally enter our home without consent.

Magistrate Jonathan even had to threaten her with being arrested and charged criminally if she entered our home. These people have no morals, ethics or respect for the law. They think they are too big to be held accountable but I beg to differ. Screw them. I’m not going anywhere and I’m not giving up my home. They are in for the fight of their careers. I will fight for our home with everything I have and I will take as much of their money for damages as I possibly my can get. It’s the only way to prevent them from doing this to someone else and quite frankly the personal injury they caused to my wife and daughter and the stress to myself is in my opinion deserving punitive damages to be recovered to me and my family.

 So I had a meeting today with attorneys Mario Keruger and Rusty Bolts that went very well. So let me share some frugal information for you Jerry...you’re in big trouble there chief. So you not only committed contract fraud and contract manipulation but it’s just as we thought...you can’t allow the sale of our home to anyone but us. So this is our notice to you that we are suing you for our home and you will have to sue the homeowner.

In addition we are filing for damages as you lied, cheated and deceived us all of which we have in writing. You can’t say you’ll sell us our home and then say "we aren’t selling it to you now because we are afraid you’ll sue us because we don’t want to honor the contract”. That’s the definition of fraud. Then you put in writing you’re going to still sell us our home but under a new contract that doesn’t hold you responsible and then you put in writing again you’ll sell us our home for the same price and all.

Now you refuse to sell us our home? You lying pieces of sh*t! You’re not going to get away with this. I’m dragging you to court and once a judge hears what you did, you’re going to lose. I want my home and I’m not letting you out of our contracts so buckle up Jerry because you’ve never come across someone like me in court. I won’t stop until our home is ours! You WILL honor our contracts!

First of all Jerry, most of what you have stated is false, misleading and extremely deceptive. Tell the truth. YOU AND REMAX ELITE deliberately consipired with each other to cause delays and refused to fix our home. You schemed a plan to drag it out beyond the contract deadline so you could get out of the deal and sell it to someone else for more money.

I’m glad you just admitted that you canceled our contracts willfully because you just proved one of the things I am suing you for. What you have done is called retaliation! It’s called contract manipulation and contract fraud and my attorneys are filing on our behalf. Our home was indeed damaged from the hurricane but you got so angry when I help you accountable to our contracts in buying our home so your solution was to get em out of your hair and deliberately sabotage my contracts.

Sara told my wife and I directly that she told Mandy and the homeowner to not make the repairs on the house. It’s so slimy and despicable it’s disgusting! I demanded the repairs to be done the right way and they were not. Sara also said just like you said "we are not extending the contracts because we are afraid you’re going to sue us”.

Well you’re right in that and the law protects me from bullies like you retaliating against me for holding you accountable to our contracts. You can’t manipulate a deal when it doesn’t suit you anymore. Your deceitfulness and lying is so bad there is no way we will lose in court. How many times after you and Remax Elite took it upon yourselves to viciously and egregiously destroy our contracts, say "we are still selling you the house for the same price? Many many many time.

You are a filthy liar and I am excited...no estatic...no....I can’t wait to get you into court and tear you to pieces for they lying, manipulative deceitful people you are. You have been trying to force us to give up our home and I refuse to. You have gone to such lengths to violate our contracts, to manipulate situations and circumstances; to conspire against us and do everything in your power to take our home away from us.

Well you can go to hell Jerry. You’re a deceitful creep in my opinion. Now you can think I don’t have First Rights of Refusal but I do. It was implied with the first verbal contract Huntley Bodden and I had...of which we were lied to and deceived out of our contracts with him. We got locked into a contract with your company HBNC and you lied and deceived us too. Both you and the homeowner have made promises and renigged on them while we have ALWAYS held up our end.

I have lied about nothing but have been continually been taken advantage of by you, Remax Elite and the homeowner. Well enough is enough and I’m taking your asses to court and I’m going to sue you for every penny I can get. You brought physical harm to my family, you have stolen our home from us and you e lied, bullied and manipulated us for far too long. You have ZERO credibility and I have an overwhelming amount of evidence that proves everything you have to say is questionable.

You can’t be trusted. Like I told you back then "I’M NOT LETTING MY HOME GO!” You can’t bully me. I refuse to let you force us out of our home so you can make more money and it infuriates you. Good, because I’m going to be in your face legally until the home is ours. You’ll be receiving letters from our attorneys soon so keep watch for the mail. That house isn’t going anywhere except to us! Deal with it!

We have read John's report.  Here is our version of events:

8/2018 - Home buyers had a contract to PURCHASE the home from the seller, who was John's landlord.  We agreed to sell him the property once we bought it from the seller (he was the renter/tenant at the time).

9/2018 - Hurricane Florence came through and the tenant refused to allow contractors to complete the necessary repairs.  Several contractors quit the job based on the verbal abuse received by the tenant.

As a result of not allowing the contractors to complete their work, the tenant was evicted so that the landlord could make the home repairs.

10/2018 - The contract between the tenant and Home Buyers had expired.  The extension had expired.  The contract was also voided prior to their eviction.  They did not have a "First Right of Refusal," which is a legal document.  No one is guaranteed a First Right of Refusal.  Due to his constant threat of legal action, we voided our contract with the tenant. 

We have been actively trying to return their deposit, but they will not give us a forwarding address.  We have proof of our attempts as all of our calls are recorded, for quality assurance purposes.

The report is false and we have an excellent reputation helping people sell their homes.
