Home Guardian Solutions (HGS) sought to represent me to reduce my mortgage rate.  I "qualified" for a federal grant under the Home Saver program.  www.grant.gov does not list any grant with the words "Home Saver" or "HomeSaver." HGS suggested, but did not promise, that I might qualify for a new mortgage rate of 3%.  HGS said they would use my being laid off and my disability to justify a lower rate to the mortgage company.  None of the documents they emailed me contained any specific reference to the grant.  Apparently, HGS would handle all the grant qualifying paperwork for me.

HGS wanted $1,995 for their assistance.  HGS said the Home Saver grant would cover the other half of the costs of the mortgage rate lowering transaction.  So they represented that I would receive the grant which would reduce my refinancing cost.  I just needed to send HGS $1,995 to start their work with my mortgage company.

A person at the WA State Department of Financial Institutions (DFI and dfi.wa.gov) said HGS is not licensed in WA state.  HGS said it did not need a license in WA for their business.

The California Attorney General's website (http://ag.ca.gov/loanmod/index.php#) states "Foreclosure consultants are prohibited by law from collecting money before services are performed."

I concluded HGS attempted to defraud me.  Thus, this report.

I've applied for refinancing of my house since last August (2011) and paid a refinancing closing cost of approximately $2,000 in advance without them doing anything for me.  It has been taking them several months to have the refinancing processed with the excuse that they are extremely busy and backed up in the process of negotiating, while in the meanwhile I have been paying the same amount of mortgage payments for several months with little progress.  They either told me in the meantime that I need to send in additional documents or they are still backed up in the negotiation process.  We are fed up and want to cancel the refinancing totally as we've gotten no advantage so far yet have paid a closing cost against the California business law (which the company should clearly know but decides to violate anyways preying on the ignorance of out-of-state homeowners).  We have demanded for the cancellation of the refinancing and a full refund of the closing cost, but despite repeated emailing and calling, the company decides to totally ignore our request.  Do not defend yourself with the above euphemism for mine is a clear case of obvious fraud that is already committed.  This company lacks ability to timely process and service their clients, lacks integrity (preying on the ignorance of clients of California state law in regard to completion of services before collecting fees), and lacks professionalism.  I am giving them an F and would warn anyone to avoid any more frauds from this company.  Incidentally, their website is now changed and so is their phone number.  Isn't this an obvious case of fraud?  I demand an immediate refund of my $2000 closing cost and would like to ask any lawyers in California to help me out in this case to reclaim my justice.  I would be very surprised if I ever get a reply from this company in regard to my refund since they've been avoiding and ignoring me regarding the refund for 2 months now, an obvious example of lack of professionalism and integrity from a business.

As I can recall, after the accuser decided he did not want to move forward with our services, he was offered additional services at no cost should he choose to move forward with his lender by himself. As with all of our potential clients in an act of good faith, we advise that our underwriters help out clients who may not be able to afford the fees with contact numbers, program guidelines, and even a review of packages before they are sent to the lenders. Our company policy is to take on at least 100 pro-bono cases per year in an effort to assist the community and those who just cant pay the fees. Additional seminars and online tutoring is available also at no cost courtesy of HGS.
As for our fees, and licensing. HGS is not a financial institution, and therefore does not require a lenders or financial license in any state.

Hardest Hit Fund programs vary state to state, but may include the following:

Principal reduction to help homeowners get into more affordable mortgages
Funding to eliminate homeowners second lien loans
Help for homeowners who are transitioning out of their homes and into more affordable places of residence.

The program we had planned on looking into the "Home Saver" is available on the last state of that webpage, and specifically offers alternatives and incentives for unemployed homeowners,  but in error it is for Washing D.C. not for the state of WA. However, through HAMP you would qualify for the unemployment program which allows temporary rate reduction while you look for a job, and to help ease the financial burden.

We do not market or target specific states that do not allow the collection of upfront fees for foreclosure and modification services. We are in compliance with all local and federal laws. After filling out an application and submitting it for review with our underwriters, potential clients are either approved or denied, based upon their particular financial situation. If approved, the program we intend to access is explained and the goal is not only documented in black and white, but backed by a money back guarantee.
