My husband is 100% disabled, confined to a wheelchair, and a heart patient. we had to file a chapter 13 because of certain health crisis' we got behind on our payments, the chapter 13 is payroll deducted, so if you don't see it, you don't miss it kinda deal.

I have done the arrangements with "hometakers" on several different occasions, thinking that everything was straight, just to find out there was more,and start all over again. at least 1 property inspection a month. and just when I thought all was good, the wolf was at the door, with a forclose letter. (hence the bankruptcy) to save my home, that is handicapped accessible for my husband.

after a year and a half, no late payments, I get a Motion for Relief. they said that i am 2 months in arrears. BS I spend an extra $13.00 each month, Western Union, and have the reciepts.

Just fishing around on the internet, I found this site, and started to read many of the fellow victims comments, I am affraid that even though I have bankruptcy lawyers, and they have copies of the reciepts, and my lawyers will get with their lawyers, that these bastards will still take my home, the worth of the home is almost TWICE the amount of the mortgage.

If I lose my home, this will take its toll on my husbands health, I am affraid that he will suffer,yet, another heart attack.

I have recieved all kinds of bankruptcy buyout offers, to refinance, but I don't want a higher mortgage Its getting to be all i can do to afford this one. I fear that may be my only hope and chance though.

any help or suggestions are welcome.

these people have sent me a forclosure letter, telling me that I am behind in my payments. yeah, I admit that; that is why I filed ch.13. since I filed. 19 months ago.

however I have NOT missed a payment, and I find out that NOT ONLY did they change my account number and never sent me anything about it (it was changed earlier this year), but they have been applying all my post petition payments WRONG. I know this because I requested a payment history from them, note: that has been the only thing that they HAVE been able to do, and they have no clue what is going on.

The reason I requested the payment history was because no one in their "office" could tell me what 2 months payment I am missing. or well actually that they are missing because I have proof of all my payments made, and copies of canceled checks.

Now, after all this, and undo stress that they have put on me, I cannot wait till our court date, because their lawyers have finally responded to my lawyers My lawyers tell me that they still do not know what months I am behind in and that their lawyers want to offer me a repayment plan for the 2 months that are mysteriously missing.

Can someone please tell me why I have to repay on payments already made? I'll tell you what I think, and that is that 1. someone is skimming our money off the top, and 2. greasing the palms of people with connections who have connections to screw us hard working folk out of what they can. and they're getting away with it.
