I have a consumer complaint with my mortgage company I am not quite sure which agencies to contact. My loan originated in August of 1998 with one company who sold my loan to a conglomeration of Financial Institutions that passed my loan around and severely took advantage of me and my family.

I have been fighting with them for the past two years, since September 1999 when I was in the hospital with a two broken vertebrae in my back and a broken write arm. As I am sure you can imagine it this fight has affected many aspects of my life. After a year of fighting with them, I could no longer fight this mortgage company on my own.

I had paid them thousands of dollars that they lost or put in a Suspense Fund they intimidated and harassed me until I signed an agreement to pay WAY more then I owed. I finally hired a lawyer in September of 2000. My lawyer requested a full mortgage disclosure that we still have not received.

They only sent partial records. They claim there are no records before 5/11/00; however, they demand that I am in default. My lawyer requested they have a qualified representative go through there records on a conference call with me as it is clear there are errors in them.

My lawyer pointed out that they made mistakes in their records; I received a letter from homecomings dated February 15, 2001 stating the they received notification that a problem existed regarding your account and This letter is to inform you that this issues has been resolved and the information on your loan is now correct. They even apologized in the letter yet continued to pursue foreclosure and refused to settle this issue amicably. They did not take this opportunity to be reasonable. They filed a claim. We filed a counter claim.

They denied the charges. There are many more details; this only sort of summarizes what I have gone through in the past two years. I have a file about 5 inches thick.

I am only including my counter claim at the moment because of the shear mass of data including canceled checks and other documents.

am not perfect and do not claim to be, however the errors made by Homecomings is Insurmountable, and the manner that they have taken advantage of my family and me is unforgivable.
Homecomings goes by many different names and they have locations throughout the country.

I have added a list of different names they do business under.
At this point I am not sure where to turn or what to do. My lawyer believed that this was an open and shut case when he took it one year ago. Now thousands of dollars later and lots of hard work by both of us it is still lingering with no amicable resolution in site.

I am reaching out to your agency to basically beg for your assistance. If there is anything you can do, investigate, or a way you can assist. Please let me know.

Homecomings Financial threatens us with BS

Homecomings Financial holds our home equity loan which we are paying off faster than required. Nearly every month one of their goons calls us with somewhat threatening statements or some kind fo baloney. We have never given them reason to report a payment past due.



Today, they called again and stated that the post office had confirmed we never sent our payment... yeah, right..the post office remembers every piece of mail, including the ones where the double window payment envelopes have Homecomings Financial in BOTH windows...give me a break!



In fact the payment had been mailed. My husband told them to stop harrassing us and now they won't talk to him anymore, they only want to talk to me and they ask for me specifically by name. This is also a case where the original loan was sold to them.



We think that, 1. they are scum, and 2. they probably realize wer're paying it off faster so they're not going to get all the interest they thought they were, so they're going to hassle us.



Don't do business with Homecomings Financial, they are a Mickey Mouse organization that relies on stupid threats and unethical business practices to intimidate people.

I have found many others that have been abused by this company. They are a GMAC Company Bank One is in there somewhere. I urge you to contact me if you have had similar problems with your mortgage company. Especially if they are affiliated. The errors made by homecomings are insurmountable, and the manner that they have taken advantage of my family and me is unforgivable. At this point we are putting together a website at www.homecomingspurgatory.com to join forces against these companies. I am reaching out to all of you that have also been abused by these companies. Register on this site. Put as much information as possible. We are pursuing a class action suit. Be assured that there are many people out there just like us that this company has hurt. Many family's that have wrongly lost their homes.
