We are in desperate need of some good legal advice regarding the dealings with Homecomings! In October 2008 we contacted the company due to growing concerns that we were struggling making our house payment resulting from a cut in pay. We spoke to several different "loan service agents" who claimed because we were not 30 days late we were not considered actually late and for that reason the only thing they could suggest was to refinance. We explained that all we needed was to fix the rate and to allow us a 2 month forgiveness repayment program since we would need it to catch up and pay off other bills. Our payments became later and later...in December we sent a formal request in writing and never even received an answer back from them. The only reason we know they received it is when we called to notify them of when we would make the payment we asked and they acknowledged receiving the letter. Again, they said only 1 time 30 days late would not constitute consideration of loan modification and to call back after we made the next payment.

Finally after we begged for consideration in February they sent us a loan modification work sheet. We filled it out and faxed it over...never heard a word until a woman came to our door in early March inspecting our home and told us to call Homecomings. We immediately called Homecomings and they started again asking for a promise date on a payment without even addressing the loan modification pw that had been sent in. When we asked she supposedly pulled up our account with the notes and without hesitation said "we can't help you". We hung up the phone and attempted to make a payment on March 24th through our direct pay with our bank...a week later the payment was credited back to our checking account and today we were served with foreclosure papers (we are 90 days behind with the refusal of that payment). These people are crooks they do not want to assist us after collecting $140,000.00 in interest in the last 5 years.
