HEllo ANYONE!!!

I hope you can refer me to a local GOOD attorney. My family and I are having problems with our mortgage company, Homecomings Financial.


Thanks to Homecomings embezzling our insurance payments, our home is still not fixed....a Very HARSH winter lies ahead.

Last October Homecomings Financial solicated us to start an insurance policy through them. So they established an escrow account as a way to collect the payment for insurance on our home. It is my understanding that Homecoming has assumed responsibility of maintaining an insurance policy on the home, once the escrow account was established for that purpose.

Recently, we needed to file a claim for water damage so I called Homecomings for the insurance information. At first they gave me a name and policy of an insurance company that I did not recognize. But, I understand it is common practice for mortgage companies to switch insurance companies without notifying the home owners.

When I called the insurance company, they said the policy was canceled in May. I called Homecomings and asked for the correct insurance information. They gave me a number for a different insurance company. This "new" information was wrong. ( I kept getting disconnected at this number.) I called them back and now they deny even having an escrow account for us. (The information on our escrow account is on every statement they send us.)

We have all of the paperwork and letters regarding the establishment of the escrow account. Our property has water damage, and they are not being cooperative.

Another concern of mine is the health hazard my family might be experiencing directly from the delay of fixing our home. I have notice our family members having unusal, almost flu-like allergy symptoms. My children wake up with red swollen eyes and a cough.

I've spoke to some lawyers. They agree I have a good case.

After voicing our concerns, Homecomings has now denied our last payment. We call them and keep getting transferred. My husband has left 3 messages each day. I also left a couple. Now we've received a foreclosure notice in the mail.

We called them asking for an explaination, the rep. told us to make a so called "Payment Arrangement." But, this payment arrangement starts has an 1,800.00 fee to start and doesn't even go towards our mortage payment.

Is this even legal?!?

An insurance adjuster has finally arrived, today. But, the problems with Homecomings Financial has not dissappeared. Here is a copy of the letter I wrote in response to their extortion attempts. I email it today. October 15, 2004

To Whom It May Concern: We have been trying to make our monthly payments since September 2004. Homecomings Financial is refusing our payments. We can not even access our online account. Homecomings Financial is also trying to collect the wrong amount from us. We will not pay almost 2,000.00 in "legal fees" to prevent a foreclosure. We are seeking the advice of an attorney to prevent this extortion.



This is not the first mistake Homecomings Financial has made. They were also collecting money from us for homeowners insurance. But, instead of paying for insurance, they were keeping the money. This mistake was not notice until we needed to file a claim.

one payment behind does not a foreclosure make if they are tring to do this its wrong read your contract with them somewhere in there it states how many payment you have to be behind

second you say you have spoken to several attorneys well get off the potty and hire one i have been dealing with this company for almost two yrs now and i have my second court date comming up in nov this time they cant back down im going to have someones left nut when its over

as i have stated before in my report gmac deaf dumb and blind
