In June 1999 my husband attempted suicide. I called Homecomings and advised them of the situation-they told me to call 911! We ended up filing for bankruptcy as my husband did significant damage to himself and was unable to work for 6 months. We caught our mortgages up after the time elapsed on the bankruptcy.

We have 2 mortgages both through Homecomings. The 1st tried to foreclose on us even after we filed request to reaffirm the loans in bankruptcy. Our attorney intervened and we were able to stop the foreclosure process with my parents help.

After 9-11, the company my husband worked for filed for Chapter 13 Bankruptcy and his ability to earn income dropped from $1800.00 a month to $450.00 a month. I work also-but with medical bills, etc and the amount of the 2nd-which kept raising (12.75%) we were unable to make full payments-I mailed written and faxed notice to homecomings advising of situation and requesting assistance. Their response-file for foreclosure on the 2nd mortgage.

I have called Homecomings by my documented records
187 times-I have held for up to 2 1/2 hours and been transferred to 9 different people during one phone call. Homecomings made no offer to reduce payments, forebearance, etc. I found out about these options from my State Senator. The 2nd has now sold the mortgage back to themselves-they won't give me payoffs and basically tell me that want us evicted. Through all this the 1st
is current and up to date.

I have been offerred no hope and I have filed complaints with HUD, which according to Homecomings is why they won't work with me. Now I didn't file complaints against Homecomings until August of 2002-10 months after I began this task. I am currently attempting to refinance-through another company-at a higher interest rate, of course, and in going back over my loans from date of origination until present-I have found several errors that amount to a couple of thousand dollars that I have been unable to get Homecomings to account for. If others would like to pursue a Class Actionn Suit I would love to join in.

Service should be the number one priority-I can't believe they'd rather have my meager home (1800 sq ft total) than the money. I think it's more of an issue of control and CYA than it is to assist those who aren't perfect.

Used to own property in Los Angeles County, I think the OP is missing something.

Okay, I'm an going to bare my soul and come clean.

In CA (LA in particular) after you are 3 months past due on your mortgage, a lender will file a NOD. I know this from personal experience.

If you are 1 month behind, no problem, 2 months, no problem. Once you get 3 months behind, your lender will accept nothing less than all their money. They will wait until you are 4 months behind to file a NOD. Then and only then, will they work out a payment arrangement with you.

In the interim, the will send you certified notices, visit your home and leave a note on the front and/or back door and call you at home and work.

I am not defending GMAC or any other mortgage company. This was MY PERSONAL experience on 1 occassion due to illnes and job loss.

PLUS, since property sales, taxes, etc. are public record, the SHARKS, I mean the "helpful" Real Estate folks will start calling you, putting notices on your door, YOUR NEIGHBORS DOOR, and in your mailbox regarding how they will buy or save your home. Don't believe it folks!!!

Bottom line: If you make your payment via check or online, verify that it has cleared. Record any conversations with your mortgage company and stay on time with your mortgage come hell or high water!!

I knew within 48 hours of the NOD being filed that it was filed. To get to the actual SALE takes on average 6 months. You are telling me , you did not know you were 6 months BEHIND on your mortgage?
