In July of 2001 I entered into a repayment agreement with Homecomings Financial. This was due to my ex-husband not paying the house payments by fraudulently sending a check then cancelling it from the bank.
By the time I had found out and kicked him out I was 4 payments behind.

My case was turned over to Teri Salas, who was about the nastiest person I've ever spoke too. Other then Scott Shaunasey! I had no problem in repaying what was owed and went after my husband, a conman (ALAN G GREENBERG who works for Honeywell here in AZ, and is now on PROBATION. I was on my own and after only 3 weeks of marriage I was now totally broke and about to loose my home.

I was the one that immediately made contact with Homecomings to get things hopefully taken care of the right way. They literally tacked on about $260.00 per month plus then an escrow account added another $150.00 Taking me from $832.00 to right at $1300 per month. This made me behind on all my other bills also. I lost 45 days of work due to the emotional and mental stress, plus my own personal business suffered. The rest of my payments I could not pay. All I could afford was my insurance for medical and my car, plus my car payment and that fell in the rears. I finally have that caught up.

I continued to send in my payments according to the agreement until there was a mix up on my part in Nov. I got that straighted out and sent alot of money in by this time. In fact within 9 months I had sent in over 14,000 to repay this loan.

Then they came along and added another 150.00 per month on for an escrow account which I had requested when I purchased the home. That was never done yet they kept billing my sister for the taxes since she was the original owner. She still gets bills today!!

After fighting them from 2001 and dealing with Numerous personel such as Bonnie Fuollen who told me there were two accounts with enough money in them ($2600) to cover the next two months on my payments and said to only send the final payment in. Which to my trusting her, I was screwed over and this was denied by her at a later time of course.

Twice during this period my payments were returned due to their own negligience. I was even told by Teri Salas that they have no idea what the financial dept is doing compared to collections. And again I had to have a substantial sum of money to them by a certain day and certain time or I'd be back in foreclosure. I made in just about 6 days in March and April of 2002 numerous phone calls that were never returned to Teri Salas, which she had noted them but never returned them. When I asked her why she didn't she said she just didn't. Finally the major blow came.

On May 10th I had a man show up at my door stating that he owned my home and had puchased it at auction on May 8th. Never at ANY time did I receive any notice and had even made my final payment on April 26, via Western Union that should have had paid this situation payed off.

Instead they sent my home into an illegal foreclosure. AS Noted by the a judge, *as and illegal foreclosure and a investigation and charges were pending along with my lawsuit."

Needless to say I was devastated! I am a single woman and work two jobs to make ends meet. Only to have it taken away by these idiots. I had called and called and finally on May 12th I recieve a letter dated May 7th to contact Homecomings to reinstate my mortgage. Gee how can you respond to a letter that you recieve on May 12th that is dated May 7th, and at no time in that letter was it stated that my home was in foreclosure, just that I should contact them to fix this situation.

On the same day I recieve a letter from Western Union telling me that my payment had been DECLINED! I immediately called Western Union and purposely left the money in that account for over 26 days. They also told me that Homecomings is notorious for allowing payments to sit for at least 15 days or more even cash payments that they recieve within fifteen minutes.

Needless to say I called MS Salas. I waited for over 30 minutes to talk to her on my cell! When I told her what had happened her reply was "I don't know what to tell you. There is nothing I can do about it now!" I was furious. I immediately contacted my attorney and had written down the contents of the conversation. As I have with everyone I've spoken too. Teri Salas' assistant told me that she's very rude and acts like she out to get everyone!

For two months I fought very hard to hang on to my home. The man that had purchased the home had no bill of sale or anything other then a hand written reciept which meant nothing to me.

Finally we went to court. I had kept him out of my home for 2 months. He was proven by no fault of mine or his that he was the bonified purchaser, and that if I moved within 5 days they would not charge me any attorney fees, court costs, monthly back rent. etc etc.. I also was found to not be EVICTED and that this was an illegal sale with stipulations. I fortunately found a home to rent and moved within three days with my ELDERLY parents helping me. I had to borrow over $10,000 from their Credit card to help get me out of this.

On top of everything I else I received a notice that there was money being held by the Title Company, Capital Title in lew of over $10,000. That just payed to recover that my moving expenses and not even the money I still owed to the credit card co. I still owe that. Needless to say that after being threatened with their name being added to this lawsuit they could either turn the money over or they could join the suit, they payed up!

I only of course got back about $7800 of that. I had even tried to call as high up as Chris Caroul at GMAC only to be told that they are no longer handling Homecomings problems. Gee I wonder why?

Now several months down the road, and about two weeks ago we get a call from their attorney, One from Homecomings and one from Bank One and another yet from the company that purchased my home. They all of a sudden want to settle! I'm not settleing for less then a sum that will be their worst nightmare!.

If they want to fight more we go to court. We are more then prepared! They sent out a notice where they even asked for an extra 10 days to respond to our suit. To my suit they responded with the fact they knew nothing about alot of nothing. Only where they showed payments were NOT made.. or posted as not made, funny I have all my reciepts from Western Union. We just finished with our disclosure statement. So I am sure we will know something this next week.

Basically there is another sight out there. Go to www.baddealings.com Use all means and contact an attorney on a contingency basis. There was just a MAJOR case settled and payed on in UTAH. There are more and more.

I'm here to help anyone that I can because of what they did for me! I believe this all happened for a reason. And this is it. I'll do whatever I can to help. Many many out there are losing their homes to these crooks, and it's time we start making a stand!

We have had problems with their predatory lending practice. We see many TILA, RESPA and other violations, however, our town is very small and the "good ole boy" attorney's don't want to mess with truth in lending law and we have heard several times now that just because its a law doesnt mean it will be upheld, that's why there is a JUDGE, to judge what should or should not be done. We had to file a 13 bankruptcy to get to stay to buy time to figure out what to do. My husband has a 25 year old business in our home, and 2 children. Our business has suffered as well, as its small town gossip and the foreclosure being in the paper reduced our income about 60%, of course now this makes making our payments really impossible. They do not "work deals" they stated when I called asking to be refinanced. Since we filed the BK and are stated income, and now little stated income and 100% loan to value there is no way to refinance. Our new marriage has suffered so much and counseling has become an expense we cannot handle. The children have choosen to move in with their mom due to all the stress. If my husband loses the home/business he wants to start over again, the nearest major town for his business is 50 miles away, and now is devestated he cannot move from his children. We are in such a catch 22. Any advice would greatly help. We have very little saved up and holding it in case we need a lawyer. We just received notice that Homecomings filed a motion of relief of stay due to lack of Enough payment!

I am so sorry to hear of your battles with Homecomings, et al. I too am battling with them as well and from what I've read, it appears that we are all in the same sinking boat with Homecomings, et al. being the captain who is bringing us all down for their own gain. Yes, you're totally right...they must and will be stopped. Ironically the magic dollar amount with them appears to be an increase of $150.00 a month due to "escrow" payments. Also ironic is the fact that no one else in my neighborhood, where we basically all pay the same amount in taxes, have had this drastic of an increase in their payments. In my estimation, this is called "Predatory Lending" and is illegal. Therefore, if you can find a way to bring them down, count me in. If not, maybe we can put our heads together and find a way. Deal?

Bank One Discriminates against Females

I am a Female middle class white business owner who Bank one has Discriminated against.
Much like the case above, I mortgaged my property with Advanta Motgage in Cal. Due to business sales and receivables arriving slow, I became behind on payments with Advanta Mortgage. I had over 150000.00 worth of equity in my home at this time.

Advanta kept telling me that everything was ok. My spouse and I had assets of well over 4 mil. with debt of 1.5 mil. there was plenty of assets to cover debt. During the course of this time, Bank One filed forclosure on my property, did not send any paper work on what was filed.

They told the court that they couldn't locate us although the Sherrifs Daughter worked in one of our offices. 30 days after foreclosure, we gat a letter from Advanta stating they sold the motgage to Bank One and we would be making our payments to their office. The letter had the phone number for Bank one listed and we called.

We were told by Bank One that they had foreclosed on the property and that we could not make up any payments on the note. We were also told that within 2 weeks they would contact us to remove our personal effects from the home. This did not happen. When we called to find out about removal ofour personal property, we were informed they had removed all the property and gave it to the homeless shelters. The total of this property was well over 1 million dollars and included at least 80 thousand dollars of jewelry, six bedroom suites, living room, dining room, and a 4000 sq ft rec room with hot tub and pool table. Not to mention the 4 computers with all of our business programs and all of the office funishings.

Also removed was a 1964 1/2 Mustang that was in the barn and a collector car. All tools and tooling from our machine shop that was stored in the barn, washer and dryer stove and refrigerator, stereo's 300 cd's and 400 movies just to name a few of the items that went to the shelter. If we can be of service to you or help in your claim against Bank One, Please reply to this letter.
