My horror started back in 2006. Single mom that went through a divorce where I ended up having to refinance my house to pay off my ex-husband's mother, because she bailed us out of forecloser. Went with another horrible company - Ameriquest. Once I got to closing not only did I have to pay back his mom, but I also needed to pay back a lien that my ex had on the house. I retained the house because of the children and my ex did not want to pay child support.

So, I'm paying a mortage that was high due to my credit - tried to refinance and pay off all the bills and bring my mortage down - went on line and Homecomings Financial called me - swift talkers - before I knew it - I had a closing at my house with a woman and her husband and my mortgage was in what I didn't know an adjustable rate.

So now we're in Febrary of 2007 and I'm behind in the mortgage - I called and spoke to someone - after giving the mortage company 2,500 dollars I was told that they were going to put me in a payment plan to bring my mortage up - so split the amount I owe into my payments -so I'm paying the amount that was quoted to me - roughly 2,300 come to find out that I never was placed in a payment plan by an employee who had only 2 months service and that the payment plan that she placed me in was due to fail in May because Homecomings was no longer using the payment plan.

Meanwhile, the rule was I could not send the money via check, or debit card, or pay directly from my checking account online, but to go to Western Union every month and send it that way - an additional 12.95 every month - and to this day Homecomings Financial cannot tell me where my 16,000 dollars went towards. Every phone call and every inquiry and was never able to get a decent answer as to where was the money going towards.

So here I am in September trying to keep my house - I have reps who are talking to me like I'm a piece of trash, threatening me on a daily basis that they were going to take my house for being irresponsible. Finally one Friday night sitting in at desk at work when everyone had left for the weekend and I got a rep. I explained everything - she basically agreed that I was wronged, but if I told anyone that she would deny that she said it. She did say that she would try to help me and help me get into a modified loan.

That took 3 months to do - finally I was about to send in my payment of 2,200 dollars to get the process going - to place me in a modified loan and lock me into an interest rate of 7.14 for 2 years which is killing me - 2,600.00/per month and I go home and there is a certified letter with the amount - I needed to add an additional 300 dollars - this was December 22nd. I called and spoke to a manager who really was not trying to budge. I asked him - suppose I had already sent the 2,200 and then came home to this certified letter what would have happened?? His reply was we would have defaulted on your loan. I asked him for 300 dollars - 300 dollars that was not told to me - he said yes.

At that moment I told him that I had no where to go - my family already knew we were not doing Christmas - so lets just sit here on the phone and see who gives in first. He and I stayed on the phone for 2 1/2 hours - where did I have to go - especially since I couldn't find another 300 dollars if I went outside and tried to scape it up - 3 days before christmas - a 13 year old at home, an 80 year old mother living with me and a son in Iraq. I begged and begged, cried and finally he allowed me to send in 2,500 after Christmas. My payment every month is 2,597.13 every month and every month I'm late - I live in NY - I pay high gas, heat for the house, electric and everything else to keep a house running. Yes I could sell, but that would put me back in court with my ex - one of my stipulations was I would stay in the same school district for my daughter - so am I ready to go after horrible who represbet an organization like Homecomings Financial - yes I am.

PS - Christmas was good that year - I was in a class action suit against Ameriquest becuase of their outrages fees that they charged - and the check came in the mail Christmas Eve afternoon.

My son and I had this VERY experience with this horrible company. They continously threatened us with foreclosure and added thousands of dollars worth of "fees" to our mortgage. We finally were able to refinance to get away from them. They charged outrageous fees when they sent the "pay-off" to our new mortgage company. To make matters worse, they got overpaid (erroneously) by $10,000.00. We have requested this money be returned to us numerous times but they ignore us. Can someone please tell me if there are any attorneys that are filing a suit against these crooks? I need to know asap. Thanks.
