In late 2005 my husband and I re-financed with 123 loan which later was sold to Homecomings Financial. We were told upon signing this adj. arm loan that our escrow was included but we would have to pay home insurance on our own.

Around April 2006 we were notified by Homecomings that we were over $2,000.00 behind on our escrow payments. We had told them we thought we were paying thru our monthly payment. Well to our surprize, it was not. Unfortunately, this was about the same time I was out of work due to surgery. We became 2 home payments behind including our tax payments. They had stated they started the foreclosure process even though we had a payment plan arranged. We watched our home payment go from $1600.00 to $2400.00. We paid monthly via western union until December 2007. At that time we had the funds to "catch up" and get up to date with our house payments. They informed me that we owed $4100.00 and we would be out of the repayment program and up to date. They also informed me I did not have to pay until Feb. 2008. I asked if that was a mistake because it did not seem right, but they said yes. It was late 2008 when I received a letter from Homecomings stating that we were late for our January 2008 payment. I had called the company told them the story and they told me not to pay until they review it. After 2 weeks they stated it was their fault but we did owe for Jan 2008 and are now past due for Feb 2008. They said "sorry" and gave us 30 days to pay both house payments. Needless to say, we made all the payments (via western union) until we were up to date. That was until I made a call after I received my credit report. Homecomings reported to the credit department that we were in foreclosure for 4 months and the months that followed we were over 60-90 days late! Our home was NEVER foreclosed upon because we paid as agreed in our repayment plan. When I called they had stated they still show we are over 2 house payments behind! After reveiwing our statement over the internet we noticed strange fees and I noticed that the $4100.00 payment was not applied in Dec 2007, only $2400.00 was! I have requested western union to send a copy of all our payments over the past years and homecomings said to email/mail it to them for review. Still they are reporting us 90 days late, charging strange fees and charging late fees that should not even apply. We continue to get mail requesting for a copy of our home insurance policy or they are going to proceed with foreclosure. We have asked them to modify our loan, freeze our loan and just about anything just to help us with the ever rising interrest rates! We do not know what to do at this point, I just feel helpless. No matter what I try to do to get ahead somehow they find reasons to make more money. Is there any help for my family before it is too late????

I HATE this company!! They need to be shut down and should have been years ago! Did you find out if there are any law suits out there that we can join? I had the same experience with them. Please contact me at (((ROR redacted))) Thanks!
