Our home was sold to Homecomings Financial in 1999 from Owcen Bank when we were in a Bankruptcy .Our payments to the Trustee were $640.00 and to HOmecomings for $1,114.00 we paid each month . $10,000 of this money was not applied to our account .

We have been trying to get this matter resolved by going to The Better Business Bureau and Illinois Dept of Banks & Real Estate also,Dept of Thrift Supervision. We were told by Homecomings in July of 2003 to hold payment until our history could be researched . We retained a Lawyer from the advise of Dept of Banks & Real Estate in May 2004 and only found out in June 2005 that our house would be to sold at a Sheriff sale June 29,2005 .

Upon request from HOmecomings we sent them $5,000 to stop the sale which they took fees for their Lawyers it was not applied to our mortgage. We are still trying to get financed from another Loan Company But HOmecomings makes it impossible to do.

We are running out of time and have spent over $10,000 in lawyers fees We desperately need some advise Sale date is Aug 29th 2005. We have been in our Home for 25 years. Our Credit Score is over 643 HOmecomings even blocked a short pay from a Private Investor by not letting them buy our home for $125.000 then another offer of $145.000 they were told they would have to pay $180.000 even though our Payoff was ony $160.000

We welcome a Homecoming Class Action Suit We have tried to refinance since 1999 and always are stopped by exorbiant fees We are paying 14 1/2 percent interest rate to Homecomings. We have had over 10 Mortgage Companies trying to refinance through the years.

How can they continue to get away with this We never received a Payment book from them because they said we were in a Bankruptcy when they purchased our loan.They are not very good people We even tried to get them to put us on a payment plan or refinance us But we were told by them no one would ever refinance us. We have the income and credit rating.

i have had a problem simular to yours . and i got in contact with the division of banks . and boy did things turn around fast .
