I purchased my home in June, 2004 and never missed a payment until Sept.2005 after my youngest son, Brian, passed away in his sleep July 2005, with an undiagnosed heart condition. He was a Dallas firefighter/paramedic and was living here with me, recovering from the second neck surgery sustained after on the job injuries. Five weeks later, we were told my older son, a police officer and member of the military, had lung cancer and underwent surgery to remove his lung.

These men were 41 and 45 years old so the loss, of course, was devastating.

During the year long illness of the older son we were back and forth between the hospital and my son's home constantly and I missed a payment. I contacted Homecomings and asked for a workout package to get caught up again. They sent me the package, I filled it out and mailed it in October 2005.

No one responded at Homecomings except to send statements reflecting the late fees and payment due. In trying to assist my ill son I missed a second payment and continued to talk with people at Homecomings, telling them I needed to get this late amount caught up and still not getting any response.

In April I received two statements, showing two different balances due for the same account.

In May, 2006, they asked for a second "workout package" which I promptly sent.

In June, 2006, I received notice of foreclosure proceedings even tho I had not missed a third payment. My payment was applied to escrow instead of the mortage schedule, throwing my loan into foreclosure.

Homecomings, in June 2006, told me by phone they would no longer accept any payments until the full shortage, plus attys fees and late fees were paid.

I paid Homecomings $3000.00 in June of that year and again received no arrangement.

This continued for the next several months with my constant efforts to meet with someone, offering to come into the office in Dallas and was told the "company didn't do meetings". Each time I spoke with the company, it was with a different person, who had to be updated on all the circumstances of the loan.

Finally, after my paying $1000.00 more, an offer of "repayment" was scheduled, even tho I had requested and been told a "modification" was possible due to the extenuating circumstances.

Out of sheer frustration and fear of losing my home in the midst of the agony of seeing my son battle cancer so heroically I signed an agreement for "repayment" in which my payments were DOUBLED...in the amount of $1795.00 monthly. This was laid out in the agreement which was to be for a year's term. I made two of these and saw I couldn't continue this so filed for bankruptcy.

Later, a representative of the company told me this arrangement should have been made for only three months, which I probably could have done. She said this would have shown "good faith" and my mortgage payments could have gone back to the original amount of $939.00 or thereabouts. She even said I should not have signed such an agreement for a year.

I then again contacted Homecomings and reached a girl who told me she could help get this resolved. I pulled out of bankruptcy so that I could again make payments to Homecomings and this started the horrible process again of reaching a different person each call with no action taken to resolve this.

I now owe an additional $28,00000 or so in back payments, attys fees, late fees, etc...you name it, even tho I should never even have been thrust into foreclosure to begin with, since the company sent my payment to escrow instead of the mortgage.

Homecomings, in 2005 also failed to pay the taxes totaling $5,000. I was unaware of this until I received a tax statement, which I still have, for that amount. I contacted the company and after more of the same process, they did finally pay those taxes because my original mortgage included taxes and insurance, or so I thought. I had requested these be included in my payment.

Now my home is set for sale the first of January, 2008. I am being told if I come up with something over $2000.00, my loan will be "submitted for modification", which would allow the back payments, fees, etc to be put at the back of the loan.

I am so leery of sending more money with no real promise of relief.

Please tell me how I can obtain a fair resolution to this unfair situation. Since GMAC is parent company to Homecomings, I've even contacted them, with no better outcome.

I wonder how many military, police and firefighters would be willing to boycott GMAC and Homecomings if this were their widowed mother?

Please thank Richard who has sent his condolences and included me in prayer. What a gift. Also, please have Faye in Fairplay Colo, who works for GMAC contact me at 972 287 3336 or at e mail quitman1918@hotmail.com. I am also in touch with a group called NACA, Neighborhood Assistance Corp of America, who help folks in foreclosure. It looks very promising and they actually stage protests like the one in the lobby last week of Bear Stearns, the megabank who received the billion dollar bailout. This group is reputed to have set aside 10 billion + dollars to help rescue folks and their homes. Do contact them.

After contacting the Federal Trade Commission to file a report, contacting the Texas State Mortgage Fraud Task Force, and the Federal Reserve Board to gather information, etc., I was contacted by Laura Summers at Homecomings out of the Dallas office who told me we had a "modification" of my loan. I was instructed to send $950.00 by the 25th of Dec., which I did, and that the foreclosure set for Jan 1, 2008, was stayed.

Someone else dealing with Homecomings sent me a phone number and name for someone who had gotten a resolution. I called yesterday, got the voice mail of the person that said I would get a return call. It didn't happen yesterday so this morning I called again to get a recording saying the number has been disconnected.

Your situation sounds almost identical to mine and I finally, after over 600 emails and several phone calls, got corporate headquarters in Pennsilvania to call me back yesterday! They resolved my problems! Here is the "voice of the customer" contact person and phone number, direct! No more dealing with sales/customer service people who have no clue what is happening with your case! I hope this helps!
