Homecomings Financial Network Inc. provides residential mortgage loans and has offices throughout the United States, including San Diego, CA; Minneapolis, MN; and Dallas, TX.

Several legal professionals are investigating a potential class action lawsuit which alleges that Homecomings Financial Network Inc. has engaged in a scheme of unlawful and deceptive business practices in its servicing of residential mortgage loans throughout the United States. This includes deceptive practices when collecting monthly interest and principal payments, taxes, and insurance on mortgage loans. It is also alleged that Homecomings' mortgage representatives and consultants may have engaged in misleading and wrongful conduct with home buyers, specifically first-time home buyers or those with impaired credit.

Deceptive practices and wrongful conduct may include the following:

Imposing unwarranted and improper fees;
Intentionally or recklessly failing to process payments when received on time

Misapplying payments received to improperly benefit itself;

Prematurely referring accounts to Homecomings' collections and foreclosure departments regardless of legal and contractual grace periods;

Incorrectly referring accounts to Homecomings' collections and foreclosure departments after accounting errors occurred on the part of Homecomings;

Failing to provide customers with timely or clear information about the due date and amount of payments owed.

As a result of these practices, loan borrowers may have been wrongly classified as defaulting on their loan which may have caused consumers to fall behind in their monthly payments and subject to unwarranted fees and foreclosure actions.

If you have a mortgage loan that is serviced by Homecomings and if you have been subjected to any of the above or similar violations, please post your complaint here.

Homecomings Financial is owned by GMAC-RFC, an international financial services corporation which earns major profits each year, such as $2.9 billion in 2004.

I also am interested in any action that will stop Homecomings tactics.

We are NOT late, have paid our December payment by Western Union on 11/29, and have received notice today that we've been Foreclosed on with NO reasoning offered and have been offered a Keys For Cash Settlement Offer. By no means will we do that without putting up a fight first, starting Monday with seeking legal advice.

Feel free to contact me with any info:

I would like to know more about the law suit you are working on? I have filed my complaint on here and I am ready to do something. I have contacted 2 attorneys about Homecomings and have not gotten very far. Here is what my main complaints are : Homecomings did not pull a complete title search on my property. We had liens on our home from my brother-in-law since 1998, so Homecomings isn't even the first lien holder on our property. They did not send an attorney to close our loan. In the state of South Carolina an attorney has to be present. They also do not have a title commitment on my home, which my attorney could not believe. There is for sure more, but those are a few besides the outragous payment I am paying now b/c I can't refinance b/c of my liens. Please let me know what I can do,I am more than willing to go forward from here. I am 60 days behind at this time, almost 90...I can not pay these high payments they keep raising on me. Please feel free to respond to me at jcb2494@bellsouth.net. Wish you luck and look forward to hearing from you.
