Homeq is trying to destroy us. We have paid over $60,000.00 in mortgage payments and only $938.79 has gone to our principal balance. This in a long one !!!

In late 2000 we had financial problems. We had a hard time paying our bills. We paid what we could on the mortgage just to stay afloat. After it was all said and done we were behind a total of 5 months. Because of the situation we had to sign a forebearance agreement. That's where the problems started.

In the agreement Homeq stated we were behind 6 months which was incorrect (5 is not much better but none the less it was 5 months) We were advised that either we signed the agreement as prepared or loose the house. They told us that they would look into the extra month and apply any missing payment to the account. That never happened. The total fees came out to be $1199.81 which included the attorney, late fee's ect.

This part is key. Our monthly mortgage is $1910.86 x 6 months = $11465.16. Our down payment was $3821.72 to activate. Which according to their records left 4 months of payment + $1199.81 in fees. Our plan was $1910.86 + $491.13 for 18 months

In July of 2001 for whatever reason they claim that we did not make our montly payment. They cancelled the agreement and started foreclosure proceedings. Later we found out that Homeq refused the payment (we send our payments via Western Union) This is the only thing that saved us. They charged us an additional $2885.29 in fees for a total of $4085.10. We stated that we should not be charged because it was not our error.

Again we were told that we can fight it all we want to but unless we signed the new agreement they would proceed with the foreclosure. We had to make a new downpayment of $4803.98 sign the new agreement for 20 months. Now instead of an 18 month payment plan it turned into 27 months. The payment stayed the same $2403.00. The new agreement stated that we were still 6 months behind. Keep in mind that we had already made 7 payments of $2403.00 towards the agreement and made the $3800.00 down payment. We signed again for fear of loosing the house. Since then we have been making the monthly payments.

On May 20th, 2003 we were approved for a loan with a new mortgage company. We provided all doccumentaion needed to show our payments. Last week on June 13th, 2003 the new mortgage company received our payoff letter. To our surprise Homeq is charging us $23255.20 over our principal of $159261.21 for a total of $182466.41. How is that possible ?????? They are stating they paid past due taxes. I have been telling them that our taxes were not past due. They took it upon themselves to forward a payment even before the due date.

Here is the kicker. We have been paying $2403.00 for the last 18 months and according to their records we are still 6 months behind. Okay I agree, if they paid the taxes we have to pay Homeq the tax money. We included it in the refinance but $23000.00 NO WAY ! We need help, pleeeeeeeeeeeeeeas someone help us. We have provided all of the documentation showing that Homeq is wrong. We followed the plan, we have paid them so much money and we aren't 1 cent closer to being caught up then we were 18 months ago.

Basically we have been told just to pay the fees. If we don't they want us to sign another agreement. Who can stop them ? Why are they allowed to destroy people ? We fell upon hard times that doesn't mean that we are bad people. All I have been doing for the last week is crying, no one there cares all they want is money. I have a folder that is 5 inches thick of communications with them and if someone has a lawsuit against them I will join in and bring my proof. I am personally going to speak with someone myself. Is there anything anyone can do to help us ? Any advise ?
