well we have home equity services for our morgage company there the ones that bought our loanwell soon after they got our loan we got papers of a escrow account so we were like we dont have a escrow account they were taking our payments from our morgage and putting them in to that account then we recieved more papers saying they added house insurance to the escrow account but we have house insurance so when we payed them we gave them the name of our homeowner insurance and policy number well they still never changed it we found out later on.

(the dumb thing is u cant have a morgage unless u have house insurance somebody on the other end wasnt doing there job when they bought our loan otherwise they would of seen that we had homeowners insurance) well we have only had them for a year and on oct 29 we were served papers for a forecloser so imediatly i called them up they couldnt tell me what months i was supposly late on they just gave u a run around

so i went to the bank grab all my bank statements from all year and were not missing any payment we go to a lawyer they called there lawyer up and said for us to fax the stuff so we did well by the next week no answer i look on the caller id i realise that home equity called so i called them back and i talk to some new person this time he checks it and see's that all the morgage payment are there so i asked him what the hell is going on he says your late on your insurance i said how the am im late when we have are own.

So i try to explain this person and he just getting mad so i was going at him like a bat out of h***. So we are going back to lawyers to get this cleared up then were counter sueing cause of false information and selling are names to people to sale our house so its consider slander. dont ever go through this company if u do get refinance as soon as possible before they screw u

well as u know we been envolved with homq for 2year and 5months we go to court again on the 30th there lawyers are ridiculous there from chicago or something real winners lol but anyways we are going after them for violating federal credit act so i wonder what more is to be done but i guess this is a trial now so hopefully the judge isnt payed off already!!!

I too, was scammed by HomEq Servicing! I am currently crying out for HELP I cannot afford a lawyer and HomEq is taking advantage of this! I was foreclosed and was never given the chance to save my home! My mom put her whole life savings for down payment on my house so I have a lot of equity and this is why HomEq scammed me! I first tried doing a loan modification through HomEq and was denied because it was NEVER their intention to HELP! I then saw a complaint on the board of complaints against HomEq and read some advice from a former employee (HomEq) that he recommended homeowners to go through a third party to try a loan modification for the reason that HomEq trains their employees to not offer any kind of help to homeowners reaching out for help. So I found a mortgage company under Hope For Homeowners! I was told by Nations Choice that my loan can be easily done!At this point I was still up to date with my mortgage payments and explained that I could not afford to make my mortgage payments and pay their fee as well! So they told me that in order to qualify for the hope for homeowners program I would have to behind on my mortgage payments. The owner asked to review my original mortgage paper work. To make my horror story shorter I kept insisting on responses because I knew that I was close to foreclosure. I received a phone message two days prior from auctioning my house from Nations Choice saying that my house was going to be auctioned out! No I am sorry for mis leading you or nothing! I know that there is a conspiracy here It is just a matter of someone reaching out to please help! I recently was contacted by HomEq wanting me to sign a release saying that I would receive money if I sign release any and all rights of possession, occupancy, and all rights of redemption in and to the property, and further release HomEq, its officers, directors, employees, attorneys, agents (Lending Processing Services and it's real estate representative) and/or successors and assigns, from any and all claims demands, causes of action, suits, and damages and liabilities, in connection with the property and/our use and occupancy thereof. Please someone have some sympathy and help I need to move out with my eight-year old daughter and have no where to go. Thank you

well we got a lawyer again he actually does foreclosures the cool side about that is he used to be the lawyer that was defending the banks but not wachovia but we went to court we are gonna go through the truth and lending act which just messed them but anyways at court our lawyer wanted us there and we saw the judge and he explained the situation the banks lawyer is a fat looking slob and when are lawyer said they placed house and hazard insurance on our house and a escrow account and the fat slob was like u have to insurance on your house when u have a morgage are lawyer was like thats what im telling you they have insurance and they pay there own taxes the judge gave another continous untill May sometime i dont really remember the date right at the moment but people fight them till death dont let them win

I can totally identify with this report..... they did the same thing to me..... i had changed my insurance carrier but NOT THE AGENT.... and she had sent them the new coverage information to their insurance department numerous times (and she keeps great records and confirmations) .... in addition, they continued to process their coverage and file foreclosure because they would not apply my payments to the note since i had not paid the outstanding escrow for their coverage..... they where puttin my funds into a "special" account!!!

After three months of agruments and back in forth over my proof of coverage they had still not applied my payments and showed i was behind on my payments!!!! Since the records showed i was behind they filed foreclosure.......... i hired an attorney... the attorney wrote them and they "suspended" the foreclosure and FINALLY accepted i had prior coverage and removed the cost for the coverage from my account HOWEVER..... they required I PAY THEIR ATTORNEY FEES for their foreclosure........

Anyone that thinks this can't happen also thinks that our BANKS and AIG are the angels and saints of our world........... This insurance mess is a scam as is the property tax issues....... another tactic they have is the late fees..... i would mail my payments on the 1st of each month in hard copy check.... they would not send my check to bank... they instead would draft my account directly... draft would normally show up on my account around the 7th or 8th....... but they would not post my payment till 16th or 17th... and apply late fees to the tune of 80.00 each month....... i no longer just send my payment first class... i send it certified.... this made them angry also and they told me to stop it....... i told them, if you are going to hold me accountable for your mistakes, i inturn shall have same option and i will continue to send my payment in this manner....... the $5.00 i spend on the certified mail saves me $75.00 each month!

Yes it is in the contract that YOU are responsible for coverage on your property and paying your taxes - but they don't have any manners or even care to discuss THEIR ERRORS...... and they make plenty of them - i have proof and will continue to make my copies....... You can't bet them and you can't change the rules - but you can play their game in the same way they play it....... just READ THE RULE BOOK!

They are a service company - not a mortgage company.... they did not loan you the funds to buy your property - THEIR CLIENT DID....... and they have many clients but the property owner IS NOT ONE OF THEM - CountryWide - Chase - Deutcsh Band - New Century - Home 123 - WAMU - WACHOVIA etc........ In addition..... since their income is limited from their client (the banks) for their services...... the additional fees they make from the homeowner is THEIR INCOME in most cases......so they have plenty of incentive to make things happen to their benefit....

I think what most ppl are getting at with this company is that it really doesn't matter what the occurrence..... they are the RUDEST people to talk to, due represent themselves with "i'm gonna break your legs mafia mentality" and there is dang little communication except one way........ theirs!!!!!

well my lawyer went to court ask for a continous after 3months of having our case and he asked to be released because he is leaving town so we been looking for a lawyer homeq is trying to say we owe them 4996.00 but we dont!!!! add this up people 603.98 times 11 is how much is 6643.78 right say we were late and the amount with the late charges is 633.98 now times that by 11 what u get 6973.78 right and we recieved our interest to date for taxes and it says 4986.00 ok u still with me. 1657.78 went to the mortgage loan if u payed in 6643.78 and subtract the interest total amount would 1657.78 that means that went to the actual loan itself. what i would like to know where are they getting that amount it makes no since. i have contacted the our congressman don manzullo he's trying to help out but not as much as i would like him to be doing so my next step is attorney general lisa manigan
but if there is any lawyer in the chicago area or winnebago county and thinks they can help out please we are part of arag legal services which pays for your time so please i have untill march 19 to represent myself or find a lawyer. i talk to lawyers that were on my arag in my area one lawyer said he hasnt had alot of experiences with the foreclosure matters and other lawyer is booked in a diffrent county not taking anymore cases other lawyer is not right try to change our case to a bankruptcy matter and still try to make us pay him 353 a hour even though we are covered for arag so if anybody can help contact this page and i check my stuff every day so please

Get itemized list of fees

Hi Cas,

Have your lawyer get an itemized list of fees that make up the $5000.00 that the SCUM is saying you owe them. They are required to provide that to you. Do not get discouraged. The law is on your side. Stick to your guns. Companies like Homeq are under the gun right now. Keep insisting on an itemized list of fees ect.. Also, I know that if this goes to court, you will win, possibly coming out not owing a dime on your mortgage. Why, because they probably do not have the original mortgage note. This has been happening all over the country. Do not give in.

well we go to court on feb 11 but i still feel like im being bamboozeled the lawyer called today and talk to us and said that there attorneys say we owed them 5thousand what in the world would we owe that much when in january they finally got our insurance corrected and added over thousands of dollars back into the morgage account but now there saying 5thousands we owe which is a line a crack we have our proof but i will keep ya posted

Hi Cas,

We also ended up with these A--H----s by default. Keep up the good work with your Lawyer. I believe you. I know that these scumbags are famous for drumming up bogus Insurance coverage. We were lucky to have sold the home that the scumbags were servicing. Our new home is with a local DECENT Bank. I will always be very vigilant about where my loans ect... are going. If they are not kept in house local, do not do business with them. The ignorant answers you received were probably from employees. They are famous for their snarky comments. Just ignore them. Good luck and keep pressuring these A--holes. You will win. Do not let them scare you and just hang up on them after using a foghorn in the reciever. I will keep you in my prayers.

By the way, we always had and have excellent credit. So everyone should take heed and check out if your loans are kept in house.

well we went to the lawyer showed the proof contacted homeq servicing lawyer and what the lawyer has seen is there in the wrong pretty much what happend is when they bought our loan from novastar they didnt follow the contract.(strike against the company) and just to let u know we never had a lasp in our insurance for the people that dont know how to read!! but anyways we have proof of all payments from when we started with the company. but pretty much what happend was when wachovia went through the process of going bankrupt and they got bought out that most peoples loans got put in the middle and we got put in all the mix up cause in illinois its a 15month process for forecloser which they didnt follow so 2nd strike against them but i will keep u updated

Mortgage companies do not foreclose on home because they do not have homeowners insurance, they place their own insurance on the property to protect their interest, this covers the unpaid balance due for the loan.

The only way your insurance would cause a foreclosure is if you are not sending enough of a payment to also pay the insurance they may have put on your home too, this makes your payment short.

Did you change insurance companies? Did you tell them who has your home loan if you did?

If you have your own insurance you need to send a copy of it to your mortgage company, send multiple copies by fax or mail they will remove their insurance once they receive proof.

Make sure your insurance company has your mortgage company information so they can send proof of insurance every year.

Your insurance company will also send your mortgage company a notice if the policy is not paid.


Read your Deed, it states your lender can pay your taxes and insurance to protect their interest.

If the mortgage company is not aware of your insurance then, they can put insurance on the home and make you pay for it. It is your responsibility to send all proof of insurance to the mortgage holder.

Either you don't have insurance and you're trying to get away with something or you just need to get educated. I am surprised your lawer did not tell you this. Or did you really see a laywer? The mortgage company does not want your house and will work with you to straighten this out.

The worst thing you can do is get hostile toward the people at the mortgage company. I think you brought this on yourself.
