My loan was taken over by HomEQ in Oc 2004. Since that time I have been having troubles getting the escrow staright. It seems they had some old information about my homeowners insurance and took that to make an analysis. They raised my payment by $164.00 as well as having an incorrect escrow figure to start. My escrow is now $50 different from my P&I. I have called to get information on what I can do and how I can correct this. Every person I talk to has a different story and a different excuse. The raise in payment caused me to get one month behind. I was told they do not work out payment arrangements and could only set up post-date checks. This would keep my 30 days behind every month.

I just received a letter stating that they are moving to foreclose on the property for being one month late. When I asked them how this could be they stated that they have the right to foreclose after 1 day late. I am beside myself about this issue and no one has any answers, including loss mitigation that is supposed to be able to help. I would like to look into a potential law suit against this company for improper practices and I have taken careful notes on the numerous errors and inconsistant stories. What a nightmare.

don't fret about forclosure

It has been three years since the threat of forclosure on my property and they have not done anything as of date.
