Homeq wants to forclose on my house. Ripoff Charlotte North Carolina

I got behind on my house payments for two months with Homeq, because none of the courses I teach (I'm a part-time community college teacher) had enough students to make this summer.

This past Saturday, I got a letter from Priority Trustee Services of NC telling me that they represent Homeq Servicing Corporation as servicer for Citibank N.A. (I thought Homeq belonged to Wachovia, and that they were going to forclose on my house.

Yesterday (Tues.) I got a forclosure notice that said that the date of my hearing with the Clerk of Superior Court in the county where I live was Sept. 13, 2006 and that the date of sale was Oct. 4 in front of the courthouse. The notice also said that "The Holder (Homeq) has confirmed in writing to the Substitute Trustee (this PTS outfit) that within 30 days of the date of this notice (August 4), the deptor (me) was sent, by first-class mail to the debtor's last known address, a written statement of the amount of principal and interest that the Holder claims in good faith is owned as of the date of the written statement." I never received such a letter. Is this legit or is it a scam? Also, do I have a right to see a copy of the original letter that Homeq claims to have sent me?

I haven't had anything but constant headaches with Homeq, and as far as I can see, they are nothing but a bunch of greedy crooks.

Also when my wife called the firm, they told her that we would have to pay in addition to what we owe Homeq, $1000 for atorney fees. (Basically, they didn't do anything). Do I have a right to demand an itemized list of their charges?

Finally, when I went to the courthouse in my county, I was told that they didn't have any records of a hearing or of a sale.

Frankly, I'm tired of dealing with these people, and I think they just want to rip me off for every penny I have.

Any suggestions?

I was also a victim of HOMEQ servicing Corp.
It took me about 5 mos to sell my home and pay them off in full. And when we got to the table to close on my house they slapped on a two year pre-payment penalty that was already well past it's date. So instead of having to pay them the 60,000.00 that I owed them I had to pay 65,000.00. Which was a total ripoff.

The best advice I can give you is to buy a tape recorder do not tell them and record every phone call document every letter date , time everything. Call a local attorney and see if they will take your case. If you can't get help that way call your state representative / state legislature's office. In general make a lot of noise draw publicity "they hate publicity" , you have nothing to be ashamed of. You are right to say they are greedy crooks they are.

They will rob you blind they just don't use a mask & gun. Also call and demand the principal balance on your home know the exact payoff and be sure of the date. I made my house payment's with these people and the balance only went up higher each month. Finally , if you mentally can't stand it anymore " which I had a nervous breakdown finally" sell your hoime pay it off and get out or check yu bankrutpcy options. Hi Doug, I have an account with Homeeq as well, when I fell behind due to losing my job I contacted Homeeq and they were very understandable and able to put me on a scheduled payment plan that really helped me out. Did you try speaking with the collection department to make other arrangements to pay before you fell to far behind? did you answer any of their many phone calls? (because they WILL hound you down), did you recieve any of the letters they mail out to you regarding your past due balances? when I spoke with the collection department they went over my monthly bills with me to show exact dollar amount of what I pay on a monthly basis, after addind up all my bills and comparing it to my salary they put me on a payment plan within my means to pay to catch up on my mortgage, after we came to a budgeted agreement I was sent out certified letters of approval to make payments as scheduled. I think if you had spoken to them they could have helped you as well. I hope everything works out for you and your family good luck and God Bless you and the family.

You don't pay your mortgage, the lender goes to forclose on you and you can actually claim they are a bunch of "greedy crooks"?

It certainly sounds like a legitimate claim and if you don't do something to set things right with your lender by October 4th, you are going to be out on the street and any equity you have in your house will be gone.

In addition, if they don't sell the house on the courthouse steps for at least what you owe on it, the lender might be able to sue you for the shortfall. Every state is different, but you want to avoid the courthouse sale if at all possible.

Immediately get with a legitimate credit counselor (like CCCS) in your area and start working on a plan to get out of this problem.
