We bought a 2006 Honda accord on 11-3-14, and they told us it had been checked out by their service dept. and everything was great on the car. We bought the car for 6500 and on the way home the check engine light came on. When we took it to get inspected the garage said it needed an O2 sensor, which was $500 installed. The check engine light came back on after driving it 40 miles after the O2 sensor replacement, so we took it back to the dealership to get it checked out. They told us it needed a new engine because the head and the head gasket were bad ($4200 in repairs), and this was one week after we bought the car. We asked for a refund or trade in credit, and they said the most they could give us was $1000 on the car that we bought for $6500 the week before. We had it towed to another garage and they said the head was not bad and neither was the gasket, but it needed a water pump, an old seal, Cadillac converter, and a valve adjustment ($1525 in repairs). So, we are out $2264 in repairs on a car that they claimed had nothing wrong with it at the time of sale. The general Manger Chris Morrison will not return our calls, so now we are planning to file suit. Avoid this place! They are liars and crooks!

We bought a 2006 Honda Accord, and we had some trouble with the vehicle. At first we were dissatisfied with the reaction of Honda of Katy. However, after talking to Chris Morrison, we’re satisfied that they are doing everything they possibly can to make us happy. They offered us a great deal on a different car, and they were willing to give us full credit for the 2006 Honda Accord. Additionally, Chris Morrison offered to write us a check for the full amount of repairs that we were out. Chris spent over four hours with us on a very busy day trying to make the situation right. So, my initial experience was completely changed based on how much Chris tried to help us. My initial one star rating is now a five star rating. Thank you Chris!

Update: Chris called today, and after checking out the engine again, he is worried about the status of the Accord. So, he is putting in a new engine at his cost. I would recommend that anyone that has an issue to talk to Chris before posting here. I wish I had, because he did everything he could to help us. I am saving up for another vehicle to buy in the fall 2015, and I will be going back to Honda of Katy

Fraud by Honda of Katy

Unfortunately you do not know the law, but fortunately I have almost finished law school. There is a rule in contracts called Fraud in the inducement.

n. the use of deceit or trick to cause someone to act to his/her disadvantage, such as signing an agreement or deeding away real property. The heart of this type of fraud is misleading the other party as to the facts upon which he/she will base his/her decision to act. 

So even if the car is bought as is, any lies told to induce the contract are actionable. And, we will sue this dealership for fraud.

Was the purchase AS IS?

Before you decide to file a lawsuit, check your purchase contract. Is it AS IS? If so, then the dealership isn't responsible for repairs. Did you buy a warranty? If so, that is the avenue to pursue if the items you had repaired were covered under the warranty.  Check your warranty contract to see what is covered and what is excluded.

Did you get the 2006 Honda inspected by an independant mechanic not affliated with the dealership prior to purchase? That is the only way to know the actual condition of the vehicle before you sign any purchase agreement.

Why would you even consider taking the word of a mechanic or sales representative that works for the dealership? The dealerships mechanics' have a fiduciary duty of loyalty to their employer and not to you.

No, I don't work for this dealership or any other dealership, but I know how to buy a vehicle. Inspect first, then negotiate based on the actual condition of the vehicle not some checklist the dealership representative produces.

One more thing: a verbal statement doesn't over ride the written contract. So look at your contract very carefully to see what it is the dealer actually agreed to deliver.

NOTE:  the exception to the above would be in the case of fraudulent representation by the dealership. You would have to prove that in order to prevail. Good luck.
