Once again I am writing you regarding Honda Finance. I sent you proof that this account was closed before I even knew about it, that my gap was closed because Honda said the car was repossessed when I sent you proof that it totaled on November 16, 2010 (thus no late charges should have been assessed), and that an extra $2500.00 or so was added due to a repossession, which is fraud because this car was totaled (before the November payment was due) and I have PROOF. I already sent you the letter from the insurance company regarding the fact that the car was totaled. I also sent you a letter from Honda showing how THEY came to the amount of $15,000... I do not deny that I owe around $12,000 on this account, but I do not owe $15,000 whatever.
Honda committed fraud in several ways, and the insurance company was in on it, too. I have all the records and all the proof anyone would need. I also contacted Honda to let them know that I wanted to pay off my car with the insurance money (which was NOT the total amount the car was worth as it was only 2 weeks old!) and my gap insurance. Honda had already illegally closed my gap insurance (by stating the car was a repossession when the car was totaled) and wrote the account off months before I ever even knew about it, and they put it on my credit right away just to screw me over (after adding illegal fees of around $2500.00 for the car being a repossession). They also sold the parts left for cash after the car had already been totaled because THEY said it was a repossession.
So Honda actually got around $8200.00 for the parts of the car after it had been totaled and then ripped me with a repossession (untrue), plus they wrote off an illegal amount of $2500 additional fees for the repossession that never happened because the car was totaled!!!! Add up what they wrote off illegally, and they got more than I even paid for the car originally ($23,200) without the finance charge, which was never paid for because the car was totaled!
They had NO authorization to close my gap account but did it anyone based on a lie (totaled NOT repossessed)! They added illegal fees for a repo of around $2500.00. They initially put this report on the credit as a repossession but later changed it to a write off! Again I am sending proof that they did these illegal things and my credit report is incorrect on this matter.
I am disabled and poor ($698.00 per month for SSI) and I cannot afford a lawyer to fight this. Community Legal Services would not help me either! I would at least like my credit to reflect the true amount I owe and show that this was NOT a repossession but a write off because the car was totaled!

When your car is totaled/stolen/whatever that does NOT relieve you of the obligation on your loan. If your car was totaled/stolen, your insurance company will pay the "Fair Market Value" of the car, yes even after 2 weeks this is going to be a lot less than the balance of your loan. This is where GAP insurance comes in. GAP will pay the difference between the amount covered by your insurance company and the balance of the loan. GAP does not cover amounts owed if you are delinquent or it is repossessed.
You say that you have an issue with them saying you owe $15,000 but you say you only owe $12,000. But what is odd is that you say you had GAP that they cancelled without your authorization. Well if that is the case why do you think you should even owe $12,000?
While you can spend money on what you want. It also seems odd that you are playing the "poor card" having only a $700 Disability payment. But went out and bought a car worth 23K where based on these amounts the monthly payment is going to be probably around 1/2 of that.
It seems like there is quite a bit of information being left out.
