In 2002 I financed my home for $178,000.00 The same mortgage company and mortgage broker continued to call and mail me incitements indicating they had talked with a Appraisal Company and a Licenses Appraisal person #AL40024335 who claimed my home was worth at least 50-60 thousand dollars more.  15 months later we again re-financed at $230,000.00 but not until the Mortgage Company, Mortgage Broker, the Appraisal Company and the licensed appraisal person made multiple representations that this property was indeed valued at the new amount.  It is noted that I made approx. $40,000.00 in revenue due to the re-finance.  However, I made all payment on time for over 7 years to the tune of $139,000.00.  In Aug. 2007 the unthinkable happened.  I worked as a Supervisory Registered Nurse in the State of Colorado's Mentally/Criminally Max. Security Psychiatric Unit.  I received horrific injuries that caused me many surgeries with more to come.  My injuries included a broken spine at the T 10 along with needing to have my right arm re-constructed.  I was informed through the E.E.O.C. that I along with my male co-workers were indeed discriminated against regarding our job expectations.  I filed lawsuit within the federal court system.  However, this case died along with my original attorney (died of an aggressive cancer), and the unexpected death of my original co-plaintiff who was found fully clothed on top of his bed covers at the age of 54.  He left behind a 10 year old daughter. These events caused me extreme anguish for which I have needed mental health treatment till this very day. 

I have found it is impossible to receive justice when your employer has the deepest pockets possible.  It is still noted that after my disability I still paid another $80,000.00 towards this home.  I drained every bank account and sold everything of value to make these payments and to demonstrate good faith.  (What a mistake)  I then explored selling this home and what I found shook me nearly as much as the abuse I received at the hands of my assailant.  First, I went to a Re-Max agent who informed me that this house was not appraised correctly, as she herself purchased the same home, built by the same builder, with the same floor plan and square footage for $160,000.00 within months of my re-finance in 2004.  I also utilized two congressmen.  1) Congressman Salazar filed numerous complaints against HSBC who now indicated they own this loan (purchased from Fieldstone Mortgage).  In fact this Congressman sent a complaint to the Dept. of Justice.  When he was replaced via an election I then utilized his replacement congressman Tipton. 2) Congressman Tipton's office made multiple attempts to resolve this loan only to be ex-communicated. 

I then contacted the County Assessor who lived across the street in a nearly identical home.  The Assessor provided me 8 years of valuations.  This is when I knew I was srcewed over as the Assessor's valuation indicated that my home was worth $156,562.00 in 2003 and was worth $156,562.00 in 2004 (the year of re-finance).  HSBC then went on to play the Deed in Lieu game three different times.  I accepted all of these offers only for HSBC to act as if I never filed an answer, despite the fact I answered these offers via FAX!!!  I am now scheduled for the 120 hearing and filed a response to indicate all the above plus "who owns the loan?" all this did not matter because Pueblo's Magistrate Clint Smith sent me notice today stating he received my response and blow it off stating it only matters if I'm delinquent period end of hearing via a mail response.  That's right I was denied my day in court via a mail response.  Is this what this country is coming to.  How does one violate an equitable principle and yet get the courts to provide an equitable relief without proof they own the loan!!!!  I'm now informed that my home will be sold on Jan. 9, 2013 and I will be held responsible for the deficits that were created by way of criminal, fraudulent, miss-represented values from the origination. 

But wait this gets better and better!!!! The Mortgage Company, the Mortgage Broker, the Appraisal Company, all have had the business licenses removed and are not in business.  Also the Licensed appraiser was sanctioned and had her license removed.  Fieldstone Mortgage the orginal lender was investigated in 2008 and filed bankruptcy after their Vice President Walter Buczynski committed suicide by jumping from a bridge.  Now some how HSBC is involved with this loan and has done nothing about any of the above listed issues.  Yes, I had my health stolen from me in the name of public safety, then I had my career taken from me by discrimination, I then had my American Dream taken from me with out a day in court thanks to the system in Pueblo County.  Whats left to take?  Is there any help out there?  Or did Walter Buczynski have the best and final answer.  My name is Jim Elson I live in Pueblo Colorado the Home of Heroes  please I'm looking for one before I'm homeless.
