On December 11, 2003 I received a call from Staci Jackson #079 with Imperial benefits. She told me I qualified for a credit card with a $3000 limit for only $279. All I needed to do was allow them to deduct $279 from my checking.

Stupidly, I gave them my bank acct. # and set a withdrawal date of Dec. 23. She said I would receive my card within 30 days. Mike Horvath came on the phone then to confirm everything, he was rude. They provided a tracking # that I wrote down and that was it for then.

On 12/29 I called and they said the card comes within 30 days of the draft date (12-23). On 1-14-04 I received an envelope of promotional material about paycard, truecredit, legal coverage and several other pieces of crap. I called them and said I did not receive my card and they also said I will not receive a card but an application for a card. I confirmed that the card would provide $3000 credit and said yes.

On 1-23-04 I spoke with Jimmy Butah #007 and he apologized for application not being sent and I should receive it today. 1-26-04, Peter Smith #004 said application should be here by 28th. 1-28-04 Jimmy Butah said should receive by the 30th. 1-30-04 Peter Blake #006 said I would receive it tomorrow. 1-31-04 nothing. A BIG RIP-OFF.

"According to the Telemarketing Sales Rule, if someone guarantees or suggests that there is a strong chance they can get or arrange a loan or other form of credit for you, it's against the law to ask you to pay-or accept payment-for their service until you get your loan or credit." http://www.ftc.gov/bcp/conline/pubs/tmarkg/loans.htm

If you haven't already, changed your bank account number, and if you have another credit card, change your number on this as well. Inform your bank, in person, or written letter, that Imperial Benefits is NOT authorized to withdraw any money from your account, and they might be involved in illegal practices. It is important that you tell you bank. They might have other options for you, depending on their own policies.

To alert the proper authorities, you can fill out an online claim form at www.ftc.gov. You get direct access to the form, at their home page. You will not receive an individal responce, but they do open cases faster, where there are a higher number of complaints filed. You can also call 1-800-FTC-HELP to find other pointers.

It can't hurt to try for a refund. Be sure they are aware of your contact with the proper authorities, and that they mail you a refund in 5 working days. All contractual aggreements are null and void, where illegal practices are involved. They have had every opportunity to prove themselves legitimate, and have failed.

Report this to your Attorney General as well.
