On or about November 05, 2009 I received a telephone call from Imperial Merchant Services, represented by Richard Del Pino, he invited me to apply for a Merchant Account with low costs, no contract, next day funding, no hidden fees stating that big companies such as Mercedes Benz, Dolce Gabbana and Tavern on the Green were his customers.(attached as exhibit A). We negotiated the value of the machine and agreed on $220.00 payable in monthly fees of $ 50.00. I signed and faxed to him the application( Exhibit B). On or about December 15, 2009 I was contacted by Zyed , Imperial Merchant Services rep and told me that Richard Del Pino was not longer working for the Company and that he was going to take over the deal. By the end of December the machine was lost in the mail and I never received it. however I received the December statement from One Pay with charges on it, at the same time I received charges in the amount of $ 270.00 from Imperial on my Bank account, I immediately I blocked my account from release any money to Imperial or One Pay, later on Zyed from Imperial told me that everything was clear and that they have corrected the mistake and sent me a new machine,


 


On or about January 25 I received the machine and started processing credit cards but no money was credited in my account, on February 16, 2010 I called Pay One to inquire about my money ( $1,540.00 in processed cards) and they told me that my account was in collection, that my monthly fee was about $49.00 Dollars and that closing my account will cost $299.00 as stated in my contract. I disputed the charges and requested a copy of the contract they have in hands. I was so surprised when I received their copy that I could not believe how big companies can forfeit signatures; yes they have a fake contract with a forfeit signature. I called One Pay and I received as answer I do not believe Imperial is forfeiting signatures and that I have to talk to them. I contacted CEO SIMON with Imperial who did not wanted to disclose his last name but received no answer to my complaint. To date One Pay is holding my money and they said they will do it for six months and they are going to charge the monthly fees and termination fees as stated in the fake contract. I tried to reach a manager but was referred to U.S. Bankcard Center because they said One Pay is a market wing of them(under their umbrella). Attached is a copy of the fake contract with forfeit signatures as exhibit C.


 


This is a formal protest of the abusive financial position from One Pay for holding my money for six months with no interest and their complicity with Imperial Merchant Services to not resolve this Fraud matter immediately due to my above declaration and I reserve my right to file a Law-Suit against both companies that I think could be a class-action.

 "I was so surprised when I received their copy that I could not believe how big companies can forfeit signatures"

How in the world did they manage to "forfeit" your signature?  Forfeit loosely means to take something from an unwilling person.  Again, how did they "forfeit" your signature.

My name is Simon and i am the main operator of Imperial Merchant Services.

Imperial Merchant Services is in the business of providing credit card processing services to business owners nationdwide. Our main mission over at Imperial Merchant Services is to make an outstanding customer service or experience for any of our clients or if we are unable to achive a level of satisfaction from the client we let client find an alternate provider without applying the cancellation fee. We simply dont make any money by not keeping the client therefore we would do anything to make sure that the client is happy.

Edward was signed by one of our sales agents that wasnt clear with fees that he was paying as well as the billing platform that we placed him on. After risk management of that company decided to hold the money for risk issues that he had and not getting the deposits he had contacted our customer service and our team had resolved all the issues that the merchant had as well as refunded fees that were charged to Edward and we have a settlement signed with Edward and he is completely satisfied at this point.

If any of our clients might have any issues regarding the customer service that we provide, please contact me directly and i will make sure that we will do our best to take care of any client we have or going to have in the future.

PS please note that we are Imperial located in New York City and have nothing to do with Imperial over in California.
