My friend Clay Hanna told me about Shain West and his company, Impure Industries, which associates with MotoCross riders, club Glam, and manufactures apparel. Clay had been doing business with Shain under the name Sin Cal Productions, and he had Shain print clothing and posters for him.

Clay had told me Shain would be able to assist me in printing tee shirts for a TV show that I produce. I sent Shain a total of $410 (US) for an order of tee shirts and stickers. Shain promised me that he would "hook me up" and give me a good deal.

Shain's assistant Dustin designed a logo for my tee shirts and three weeks from the date I sent him the money Dustin told me that he and Shain had gone to the printers with my design. It was never made clear how many tees or stickers I would be getting with my order, and a work order (agreement) was never sent to me electronically or via snail mail.

It is now over two months later since I sent Shain the money for the t-shirts and I have not heard from him (he hasn't returned my calls or emails) and I have also not heard from his associates. I have yet to receive my order.

for clarification, i have no disagreements with Dustin (aka "Dork") who designed one of my graphics and i hold him harmless in light of all that has happened. no word from shain and no product delievered, but i found a friend who finally has completed a t shirt order for me and i'm happy i now have some merch.

After speaking with Mr. Shain West on the phone this evening, we have decided to settle our deal out of court. Shain will coordinate a time to collect the merchandise for me from the warehouse where it is being stored.

Mediating disputes is truly a relief, and for future reference I suggest that anyone doing business with anyone else with money involved: establish clear guidelines and set dates. This will save you a lot of grief and worry.

The Impure Industries website (Shain's site) is working again at www.impureindustries.com and I hope to maintain a working business relationship with Mr. West.

FOLLOW-UP POST DEC 15 2005 .. Shain most likely does not intend to send me my merchandise or a refund

This is Adam again, the original poster of the above comments. After communicating with Shain West and some of West's ex-business partners, I have come to the conclusion that Shain most likely does not intend to send me my merchandise or a refund.

I have given Shain an ultimatum to either send me my merchandise, a full refund of $410, or a combination of both on or before Dec 28 2005 or I will take this case to small claims court. According to messages left on my phone by Mr. West, it seems that Shain would rather me go to court than settle this out of court. I have saved and will record these messages to tape if need be for small claims.

If I go to small claims, I will add the cost of filing fees to the total damages. I have already spoken with a judge and begun to prepare for this case should I have to go to the expense of small claims.

As it appears, some of Shain's other business contacts are refusing to continue business with him. I can only wonder if he will attempt to rectify the situation before his name gets muddied. Other people who are irritated by Shain's business tactics may want to add follow up posts to this bulletin.

APOLOGY RESPONSE FROM ORIGINAL POST

This is Adam, the person who made the original post regarding Shain West and Impure Industries. This rebuttal is in response to my own post. I received a phone call from Shain West today, the business owner of Impure Industries, regarding the above-mentioned $400 clothing order.

Shain and I had a half-hour discussion about the business, my order I had placed with him, and the busy nature of the clothing industry.

What I did not mention in the previous post was that Shain and I had a verbal agreement that he could take as much time as he needed to get my order completed. I had forgotten I said this in our verbal agreement.

Shain had also told me that he was in the process of relocating from one warehouse to another, thus much of his equipment and merchandise was not easily accessible, and I apologize for not mentioning this fact in my first post.

I would like the management of this website to remove my original post if possible, as I do not wish to muddy up Shain West's name or the Impure Industries name.

For the record, I have no intentions of suing or going to court with Shain West, and I'm not trying to become an enemy of Shain or his business. This statement should quell any rumors out there.

In the bigger scheme of things, I realize that it is not easy to start your own business, especially when you bend over backwards to help others get promoted. I understand this because it is what I try to do on my TV show, and after talking with Shain the other day, I believe that he does the same for the people he works with.

Lastly, as I have said, please do not give any credence to the initial post as I was being impatient and hasty when I made it.
