Beware of this scam artist! I found out he is one of the owners of the sleep lab and the company that sells the CPAP machines (under a different name) What a nice racket to make money off of the prescriptions he writes! I would not trust a physician who does that.  Is this even legal? People should know about this before getting their "prescriptions" so they don't get taken advantage of.

Please take notice that Dr. Patel (“Plaintiff”) has initiated an action in the Hamilton County Court of Common Pleas (OH) – Case No. A1602374 – due to allegedly false and disparaging statements published by “wary patient” (“Defendant”) concerning Plaintiff on Ripoff Report. This complaint is one for defamation per se, defamation, tortious interference with existing economic and/or business relationships, and tortious interference with prospective economic and/or business relationships. Plaintiff seeks the following relief: a preliminary and permanent injunction; declaratory judgment; general, exemplary, and punitive damages; and attorneys’ fees.  Defendant must answer the complaint within the time allotted by the Court. On behalf of The Insomnia and Sleep Institute of Arizona and Dr. Patel, we would like to first and foremost apologize for any misunderstanding.  While the ownership does have a separate business for medical equipment located on site, this entity was merely established as an option for patients that either did not have insurance coverage and wanted to purchase locally or patients with insurance that wanted the convenience of obtaining their CPAP and supplies at the same location as their doctor. This entity has provided equipment to a very few patients in the last year that it has been established and as such it is a concept that is likely to be closed down.

The Insomnia and Sleep Institute of Arizona has legal contractual agreements with several insurance companies to be able to dispense CPAP equipment directly to their own established patients if they chose to obtain their equipment from us.  Every patient that is eligible under their insurance plan is explained that this is optional and that he or she is not obliged to obtain their equipment from us and that is their choice where to obtain these items; every patient that is offered this optional service is explained how their insurance provider will cover the equipment.  While it may seem that there is a lot of money to be made with CPAP equipment sales we can assure you that there is not and this service is merely provided to our patients as a matter of convenience and no patient is obligated to obtain any CPAP equipment or supplies through our center.  In fact, 75-80% of the prescriptions written for CPAP equipment and supplies are sent to third-party DME providers that have no connection with our organization and no payments for these prescriptions / supplies are provided to us.

Finally, The Insomnia and Sleep Institute of Arizona is a single entity that is comprised of a clinic and sleep testing facility that are constituted as a single business and not separate entities.  While there are several sleep centers in the Valley that also own separate DME companies with the intent of funneling business from their sleep laboratory to their DME companies, The Insomnia and Sleep Institute of Arizona is a single entity with a single contract with all insurance providers that include reimbursement for clinic services, sleep laboratory testing services, and CPAP equipment coverage for a few insurance providers.

We apologize once again for any misunderstanding or confusion.  We were just recently notified of these inaccurate claims by a few of our patients that in fact are established with DME providers without any financial connection to The Insomnia and Sleep Institute of Arizona or Dr. Patel.
