Intercity Housing - Western Mortgage Sold Used home with in house Construction Loan at 12% per day witholding Title stopping us from obtaining Permanent Financing ripoff Albany Oregon

On 9/12/02 we Purchsed a used mobile from Intercity-Housing with 500.00 down payment: 11/22/02 we entered into a trust deed, for a construction loan, with Western Mortgage, at 12% per day, which is a division of Intercity Housing. (construction loan was necessary, due to age of home, and it was to be placed on our own property, once home was set up they would then be able to obtain permanent financing).

Due to weather that winter, we did not complete setup till 6/25/03, at which time I submitted all final costs, and permits to Western Mortgage, on 6/25/03,same day final was provided by the County. They were to obtain permanent financing.

As nothing was submitted for a permanent loan by them, I obtained financing on my own, which we lost do to the fact that all paperwork could not be be completed on time. This took up through December 2003.

Early 2004 we learned that a title did not exist for the mobile home at time of Sale.

Without a title, mobile home could not be exempted, and turned into real property, which was necessary to obtain financing.

I worked daily, worrying about this as they had a Trust Deed, could take our land, 12% a day was going to eat us alive. Husband had had 7 surgies in 14 months, we live on the coast of oregon and we had to make trips to his Dr. in Eugene every two weeks. We also care for his 95 year old mother that is 24/7 obligation. Not an easy situation here. One they knew about at the time of sale.

Title was finally generated 8/23/04, but for some reason the paperwork could not be correctly submitted to DMV to get it exempted. I managed to, after several trips to Salem, get DMV to hold all documents, and let me get all the notaraized signature to get it exmpted on 3/15/05, and Permant Loan which paid them off 3/31/05.

During all of this, we have made many calls, and contacts with Mark Irving, the General Manager. Thier accounting methods, and charges added to our account are error ridden, request to correct, ignored, He can handle only one problem at a time, then that is inaccurate.

However he did provide us with a letter stateing he knew at the time of signing, the title was not available, at
one point sent letterto agree to correct charges which he did not, and agreed to drop interest to 7.190 intreset rate, which he did not do.

When funds were collected by Western Mortgage for Intercity at escrow, they did not credit us for last interest payment, or the items even he wrote in my documents from him would be done, which I told him we did not fully agree with.

I have in my hands that on 12/15/03, they did infact have title to the mobile home.

They kept the 500.00 down payment, charged 500.00 for appraisel fees that was not usable,500.00 for Delivery contigency that should be returned, wtihout explanation, they disregarded the "Truth in Lending" laws when computing interest. They have refused me final accounting documents, and any answer to why they collected the funds from escrow that they did.

I feel they should return all interest, and just send us a check for 12,000.00.

Many hours of worry and struggle, several loans at decent rates were lost, several trips to salem, to get the paper work done, countless hours of heartache and
frustration. How in this day and age, in the United State of America, can this blatant, predatory lending and behavior exist? Mobile home age went from 23 years
to 25 years old, causing increased interest rate, and less funding that we could have gotten, and were offered. All documentation is in my hands, I have more than a book's full volume. Advice from legal counsel
stated we needed to pay them off, then pursue them for their actions.

Husband has been hospitalized because of the stress regarding this situation, and have had both Mother-in-law and husband in hospital in the last couple of weeks.
Making this an impossible situation for me at this time.

Disappointed, Disgusted, Disillusioned, Dis-just plain Mad they would do this to one of the most honest, hardworking men I have ever known in my life, My husband,
who has suffered terribly with surgeries, and pain that is unbelievable, and to people who are old and disabled.
