NOW TO THE ORIGIONAL REPORT THAT WAS FILED

Park West Gallery And Park West At Sea sent different artwork than I purchased. Ripoff! Southfield Michigan

It was a shock when I received a different art piece than I purchased at auction on a Carnival cruise. Enclosed was a letter explaining that the piece I had bid on was out of stock and another piece by the same artist of equal or greater value was enclosed.

First, the decision about the value of these pieces is made by Park West and, therefore, is not an independent valuation. Second, since, as a bidder, it is my contractual obligation to buy anything I successfully bid on, it seems only right that at the time I win the bid, I own the piece.

How is it possible that a piece that now belongs to me is not available? My feeling is Park West has no right to sell something that belongs to me without my authority. If they are willing to stand behind the valuation they give the piece, they should be willing to pay me that amount since they sold something belonging to me and not to them.

The most they are willing to do is refund my money and give me a 20% bid credit on future works. This assumes I am willing to give up the piece to begin with, that I will purchase more merchandise from them, and, if I were willing to give up the piece, I would do so at the price I paid rather than the value they stated the piece has.

My opinion is Park West is not dealing professionally and I would warn others to be sure they will receive the merchandise they contracted for.
