America's Note Network - Russ Dalbey - Winning In The Cash Flow Business Ripoff, Took money, left hanging, Failed to provide services, Refuse to refund money Westminster Colorado

In April 2005, my husband received a brochure entitled "Winning in the Cash Flow Business" from America's Note Network. The brochure made it sound like a great way to make money while working at home (it came at the time I lost my full-time employment and was looking for home-based employment).

Sounded really good. The brochure stated several times that you didn't need to have money to make money and NO FINANCIAL RISK at all. There were all kinds of examples of people who had made it big in the "Note" business. We ordered the manuals, audios, CD's, etc. for $195.00 on a credit card.

We no sooner got the course than we got a phone call telling us that in order to make this really work we needed to be members in the Winner's Circle and needed the Protege Program and Russ Dalbey, CEO, was offering us a chance to join the Winner's Circle (5 months of mentoring by their "professionals" and help every step of the way, lists of note holders, walk you through your first five deals, access to America's Note Network list of buyers) all for $2995.00. Another charge to the credit card. Our 30 days are ticking away fast, but with all this help we were going to get, everything looked fullproof.

We received a few e-mails as part of the mentoring. Signed up on 04-22-05 and last e-mail received on 05-05-05 entitled "Let's Do Some Deals" (telling me to start looking for notes and contacting sellers). What happened to the 5 months of one-on-one mentoring and help??

The e-mails stopped on 05-05-05. Nothing. Waited to hear. Nothing. Sent e-mails (we were advised to send e-mails). No response. Sent letter on 06-03-05. No response. Sent certified letter on 07-01-05. No response.

Finally heard on 07-06-05 by e-mail after sending them an e-mail (same e-mail address I had been using before) advising them that I had contacted the BBB and Attorney General's offices of Texas and Colorado and that I wanted a full refund or would be taking legal action.

They turned it over to a Quality Manager and he called on 07-07-05. I explained all this to him. He said he needed to check it out and he would call me back shortly. I waited and waited. 2 weeks passed. Never heard from him.

Had to call him (quite evident he would never have called me). He still did not have copies to my documents in front of him, though he was supposedly checking them out. Said I mailed the letters to the wrong address (address taken off of e-mails from Ross Dalbey, CEO).

Funny both the letter and the certified letter were not returned to me if it was the wrong address. He said there must be something wrong with my browser if I wasn't getting their e-mails. Said they hadn't seen any e-mails from me (funny they got the one advising about legal action and fraud reports on them).

There is nothing wrong with my computer or e-mail. He said since I had access to the 1-800 number I should have called when the e-mails stopped instead of sending e-mails and letters. Stated they would not be refunding my money as the 30 days had expired.

Said they would put me in another program. I told him I didn't want any program they had to offer after all this. I told him I wanted a refund of the $195.00 and the $2,995.00. He said that was not going to happen.

Advising folks to stay away from this company. They take your money and leave you hanging. We will now be out the expense of a lawyer in order to try and get our money back.

Don't Need an Attorney

#2REBUTTAL Individual responds

Mon, September 05, 2005

I am sorry that you have been ripped off and it certainly is a lot of money. You can file a complaint yourself without an attorney in small-claims court. Usually anything under $5,000.00 can be filed and in some cases for more. If you are successful, they are also liable for court costs and attorneys' fees.

Most of these rip-off artists know that most people do not have the money, time or inclination to sue for their money they have lost. Just filing the claim will "wake them up" and they will usually offer a settlement. They will have to pay an attorney to represent them in court because a corporation cannot represent itself. I am sure they do not want to spend the money on an attorney.

I wish more people would take action to put these people out of business.

Good luck and I hope you get your money back.
