First, I have all documentation of the below information of this case.
I audited Member Forestry and Industrial Companies in British Columbia.

1. Started the job with IWA Canada Pension Plan and LTD plans as an Independent Auditor in 1991. ( Independent Contract Auditor )

2. Agreement was for me to downsize my client accounting business and Audit full time and this was accomplished by the year 1994

3. In 1996 I was told the auditor's had to complete from 50 to 90 audits per year or there would be problems and we would not achieve our commitments.

4. So in 1997 I bought a Motorhome ($ 50,000 ) so I could stay in work areas and not travel from home to work site....so instead of Hotels and restaurants, we agreed in writing that I would receive the hotel expenses and meal expenses as if I was traveling by car. ( B.C. and Alberta )
......that being 75.00 per working day & 35.00 for meals.
later this was increased to 90.00 and 45.00 ( per working day 10 to 20 each month for about 9 months per year.)

5. All went fine until December 2002 when a new administrator ( I'll call Him Mr B.C. ) was hired by the IWA Pension PLan. ( 2004 IWA Canada, a Canadian Union ) became United Steel Workers of America ( Union )

6. In the year 2000 my wife who went with me on all audits ( or she would be left at home for weeks or months ) was diagnosed with Pancreatic Cancer,
had an operation and was in remission for a year or so. but in 2002 the cancer came back and she was in Pain and on different pain pills ,and
powerful needed drugs by injection which was administrated by me.
After 6 months of failing health, vomiting, sick and pain she died. ( July 13,2003 )

7. Here is where the story starts and how one man destroyed what we had together, before and after her death. Read on...........

8. December 22/02 While my wife was sick and I knew she was dying and so did Mr B.C. he phoned me up at our daughter's house telling me that I made an error on my last audit ( before her death ) and that I better get with it or else ( My wife heard the conversation and me saying I can't lose my job now I just can't ) well he said fix the error which ended to me none after the facts. ( later ) she started crying and vomiting and said Ben what are we going to do for money.

9. My wife was ailing, in pain,vomiting etc and Mr B.C. sends me a letter stating any further errors I would and could be terminated in 10 days in writing.....still have the letter. My wife read the letter that was in my drawer when I went to the Drug store and and again she went into shock and stress.
( Thanks Mr B.C. you just helped her lose more Lbs. and this was 3 months before she died )

10. In 2001 I had asked if I could work part time until I was 65 years old, I was then 58 and my wife was 59, It was verbal, so when the time came to administer the plan Mr B.C. refused to tell the truth and said I took the time off (He lied )

11. AFTER HER DEATH.....Two Weeks after my Wife's death, Mr B.C. has me come in his office to sign a new Independent Contract ( which was really an deemed employee contract RE: Labour board to rule ) Regardless Mr B.C. wanted to lower my Motorhome per Diem from 90,00 to 14.00 ( I have this is writing, and the other 3 Auditors would still receive 120.00 per day if they used a hotel. So here I still have a 35,000 mortgage on the Motorhome and will have to use hotels and sell the Motorhome at $18,000. Nice guy right..a lose of $ 17,000...I then said I would SUE for the funds as in the first contract which he said is null and void... regardless he wanted me to sign under duress ( one week after the funeral ) he was smart right or be fired so I signed under dures. So after I said I would sue he would not give me any work, simple as that....a few yes....

12. After that day he would only give me 5 audits at a time instead of the usual 12 to 18 so I went from earning for the same period ( and the lose of the 90.00 to $ 14.00 and 6.00 ( wow 20.00 ) I paid up to 40.00 for an RV sites and at times 25.00 per day....or I paid in advance on MY credit card for a month at a cheaper rate....)......GET THIS.....I earned 29,000 from August to December 2002 and in 2003 from Aug to Nov. $ 3,800. in 2004 15,000 and in 2005 I earned 8,500..( less Expenses of 30% )....By now I was $55,000 in debt in credit cards and would have to sell all to pay the debt off.
and funeral expenses....Did he care NO....not at all.....I over 60 also.

13. Well I was going to sell our little house trailer for 15,000 and everything we had.
Good news, I did not have to, because I got married again to a wonderful lady in California who helped me pay off my debts to 7,000 plus I had a little life insurance. I'm blessed and happy and a wonderful wife again.
We both had lost our love ones, so now it's new memories. we are now 64 years old. She is a University Professor at Cal-state Long Beach. in the medical field.

14. In July 2006 I went to Vancouver at the IWA office ( had another Motorhome by then ) and asked to work from Aug to Nov again ( My wife only teaches from Jan to May each year so that's why I could audit from July to Dec each year to 2009....

14. THIS was his responds: " I will not give you any work and I don't have to, so there is no work FOR YOU," I said, and the other 2 auditor too..are not working. he says "I will give work to who I wish and that's not you "

15. He then e-mails me and fires me and I'm 62 years old.

16. I write to the head Administrator and he confirms Mr. B.C. that I will not be rehired and that's that. Then the Trustee's who I work for and they wrote. We will not change anything good day and good bye...nice guys.

17. I write a letter to the British Columbia Labour Relations Board and they deem me an Employee from 2003 and IWA offers me 800.00 wow....
later it's $ 1,800 wow I lost in revenue for 2006,2007 and 2008 approx $ 45,000 I had to take early CCP and have lost about two extra years of pension.............

18. I then went to the British Columbia Human Rights Tribunal, the letter from them was you were late in filing a complaint about wrongful dismissal and age discrimination. I was trying to negotiate with the IWA for that period of time, so it went over the 6 months ( I lost ) I guess you should never try and settle with your employer always go straight to the Human Rights.

19. That's it for now, I'm told by the Human Rights if I want to presue the matter further I have to go to Supreme Court of British Columbia...
SURE I don't think so and they all know that...right.....well who knows..

20. SO THERE, IWA and Mr B.C. tried to destroy me and my wife's life before she died and just kept it up......but they didn't win I have a wonderful wife and love again so IWA YOU LOSE BIG TIME............Bye...

I just remembered, while the above was happening...I was told by Mr B.C.
not to talk to any of the other Auditors...and they told me I was a contractor.( Can you imagine being told that. If I was a Contractor the IWA can not control my conversations with other Contractors, how stupid can they get...very...very stupid I would say....It appears the Labour board was correct in saying I was an Employee from 2003 on.
In case anyone is wondering why there is no other complaints Re: Auditors, is that there was only four of us in Western Canada...

I turned 65 on December 19th, 2008, because I was not earning what I would have since 2003 to Dec. 19/08 Mr. B.C. and Company has managed to have me lose approx. 80,000 in earnings....Thanks IWA Pension plan...what goes around comes around..
Imagine they did not care about me, or about our income while my wife was dying, if I went bankrupt, before and after her death. How evil can people get I found out, very. All this because I would not agree to the contract I had to sign two weeks after my wife died, I did sign it or get fired then...Then I got fired because I said I was an employee and not a contracter..B.C was mad and led me out of the building. My letter and small cheque was given to me by the B.C. Labour Board..so I was an employee...but the Human Rights said because I was over the 6 month clause..they would not help me about wrongfull dismissal and age discrimination...and it was not in the public interest..really then what is in the public interest...and to appeal was to the BC Supreme court...sure I'm living in California ( Orange County ) my costs would be approx..10,000 dollars or more and they all know that.............hmmmmm I just wonder...

Because of the 6 month clause in the B.C. Human Right rules, instead of receiving 25,000 I received less than 2,000. The B.C. Human Rights sent me a letter stating that my case was not in the public interest, really....wrongful dismisal and age discrimination...really..So as I said before never try and settle a dispute with any Company....go straight to the B.C. Human Rights board, do not try and settle with any Company...if the company leads you on like they did not me......soon the 6 month rule will get you....I just wonder about the power the IWA and The United Steel Workers of America had on my case with the B.C. Human Rights board...hmmmm....Interesting....
