 Jim Higginbothom of J & C Custom Homes and Texas CDRS Dispute Resolution corporation is a proven fraud, thief, conspirator to commit real estate fraud, and facilitates it through threats of violence.  He is a dangerous, violent, white collar criminal.
 I am RS Hanson of Atlantis Poolscapes, who in 2003 contracted with a J & C Custom Home Builder customer named, Terrance Wilkerson, a resident of Duncanville. His son Terrance Wilkerson Jr. was a outstanding athlete for SMU.
 The fraud took place during the construction of Terrance Wilkersons 1/2 million dollar home in the Thorntree Country Club estates. 
 
Terrance Wilkerson agreed to and signed a contract to build a custom pool and spa during the construction of the home, so when the home was finished so would the pool. He claimed the pool would be paid when the home was closed on, and the title cleared. Instead, Terrence Wilkerson and Jim Higginbothom hid the pool construction and contract from the mortgage company and the title company, then conspired to hide the closing date from RS Hanson so the closing and title clearing could go on without the question of a outstanding lien, ie, Atlantis Poolscapes contract for finished pool and spa. This total was 30,000.00 with 2,500.00 in signed upgrade addendum's. None of which were revealed to the Mortgage company, interim finance lender or the validating title company.

  On the projected day of closing, the Title company had sent an inspector out to validate the home was complete, RS Hanson found out from builder representative, and was present at the residence. Surprised, Terrance Wilkerson and Jim Higginbothom asked RS HANSON why he was there, RS HANSON explained he was told it was closing day, checks would be cut, so he was there. During the tension filled time there, RS HANSON mentioned he was going to call the Title company to find out the eta of the inspection, at which time Jim Higginbothom violently, with a raised voice, said, NO! You are not. If you call them, we will have to KILL you. After a silent, tense moment, there was a fake HEE HEE. This was repeated 2 or 3 more times, until a call came, and the conspirators claimed the closing had been delayed. A title issue had come up, and it would be another week.

  After a week went by, RS Hanson called Terrance Wilkerson for the projected time a check would be cut, for the 32,500.00 he had agreed to pay on completion. He told RS Hanson, it would be another week, then another week, and after several weeks of stories from Terrance Wilkerson, RS Hanson called Jim Higginbothom to find out if knew the actual date of closing, since he was waiting to be paid also, at which time he exclaimed, " We have been paid, 2 weeks ago or so. You havent been paid?

  RS Hanson then called the mortgage company, it was no longer in business. Then the Title company was contacted, and asked, what happen to the monies held for the pool construction, at which time a representative states, "There was no pool on that residence property." At which time they were notified there was a pool there, and it was not paid for, what were they going to do? The title company representative said, please call back in a moment, while they investigated the situation. When RS Hanson called back, he was told, they could not talk about it, please call their lawyer.
 Jim Higginbothom was not kidding, if RS Hanson had called the Title company about the inspection, and made them aware of a swimming pool and spa lien, it would have thrown a wrench into thier conspiracy to commit real estate fraud, a Federal Offense. So Jim Higginbothoms threat of violence was obviously for real.
This is the type of THUG, Texas CDRS Dispute Resolution corporation, has connected to them. What a SHAM.

Fact is...there is no statute of limitation on FRAUD. These 2 men need to be prosecuted.  Where is the F.B.I. who could prove this eventuality. Or Dallas County DA White Collar Criminal Investigations. Fact is, Jim Higginbothom covered up the fact a pool lien existed, did not share that with Title company when he was funded for building the residence. Terrance Wilkerson cannot produce evidence that he ever paid for the swimming pool. The inspection department has records of building inspections completed on the pool during the time of the home being built. The title company had no record of a pool, meaning the principles kept it secret. Even the County of Dallas Appraisal district did not have the pool on the record to charge the correct property taxes, until 2005-2006 when RS Hanson made them aware the pool existed.
The system is really a joke.
