J & J Towing ripoff unauthorized tow from I-95 accident, now they want me to pay $502.0 and sign over title to my car or get lien put on my husbands license Margate Florida
06/16/04-my husband victim of hit and run accident I-95 SB near Atlantic Blvd. Pompano Beach FL. J & J towing towed his totalled car to their lot, and unauthorized tow . Now they want $502. paid in cash for the tow,labor storage ect. and then we can sign over the car to them or they will put a lien on my husband's license. We did not authorized them to tow my husbands car from the scene of the accident. The car was not on the highway but sideways on the embankment.

J & J TOWING, HAS NOT EVER RIP ANYONE OFF, WHEN A POLICE DEPT CALLS FOR A VEHICLE TO BE TOWED WE HAVE TO TOW IT, IT DOESN'T MATTER IF THE OWNER WANTS IT TO BE TOW OR NOT, THAT'S THERE JOB TO KEEP THE ROADS CLEAR. NOW THE OWNERS OF VEHICLES NEED TO TAKE ACTION WITH THERE VEHICLE, JUST BECAUSE A VEHICLE IS TOTALED DOESN'T MEAN THAT THE TOWING CO DOESN'T NEED TO GET PAID FOR THE VEHICLE OR DOES IT MEAN THAT IT'S OKAY TO LET THE VEHILCE AT THE STORAGE YARD FOR THEM TO DISCARD. TOWING COMPANIES HAVE TO DO ALL THE LEGAL PAPERWORK TO DESTORY A VEHICLE AND THAT TAKES OVER 35 DAYS. IN THAT TIME THE VEHICLE SITS AT THE TOWING IMPOUND TAKING UP SPACE, AND TAKING THE TIME TO DO ALL THE PAPERWORK NEEDED. PEOPLE FORGET THAT IT COST MONEY FOR THINGS TO HAPPEN, FUEL, DRIVERS PAY, THE PAPERWORK, INSURANCE ALL THESE THINGS COST MONEY AND FOR PEOPLE TO THINK THAT TOWING COMPANIES CAN DISCARD VEHICLES FOR FREE IS JUST STUPID.

First off if you or your husband left the car on the side of the road the local authorities and since it was on I 95 probably FHP, had the vehicle removed. A wrecked car on the shoulder is considered abandoned. Florida wrecker company towing rates are regulated by the city, county, or state. These include hook-up, mileage and LABOR. Labor is time used to clean up any debri that may have been caused by the accident. Florida also allows the towing company to put a "lien" on your drivers license, meaning that you may not renew your drivers license or register another vehicle. Hope this helps but if your car was towed by the police, there is no recourse that you may take. the company may have handled the situation unprofessionally but you still have no recourse. Next time call your own wrecker.

The tow company didn't just snatch your car and impound it. It was at the request of the local police. They seem to dislike having "totalled" cars littering the highways. As for putting a lien on a license, how??
The lien would only be against the car. And what labor?? You say they have a labor bill on top of the tow and the storage. In Florida, if you did not sign a work order for repairs, the most the repair facility can charge is $100 per repair. That does not include impound and storage fees or towing. If the car is a goner, sign the junkpile over to them and let them keep it. Make sure your insurance company and the DMV know about it and turn in the plate.

You need to find out who contacted them to tow the vehicle. If the police contacted them, I don't know that you would have any recourse. If they did not contact them and they "found" the vehicle by listening to a scanner or by driving by, they may have broke the law. Check with the District Attorney's office and find out if they are allowed to tow a vehicle without proper authorization.
