Complaint Review: J.K.Harris & Co

J K Harris & Co First they took a deposit that was never reported paid then I had to redo my payment plan to IRS costing me more then after paying $300.00/mo. and never seeing balance decrease was dropped but am still being harrassed for payment Charleston South Carolina

I sent info many times and made payments to them and a collection agency but never saw my balance go down and contact was rejected after trying many times when I got someone I couldn't get my IRS info back or any help but I'm still getting collection calls for a large balance and nothing was ever done for me accept more bills.The collection agency is Mitchell N. Kay law office,New York and NCO financial systems.Any help will be greatly appreciated

Michael, First, the collection agency can only call you twice a week. Look up the regulations under the Fair Debt and Collectin Practices Act. Also the Dept collection rules as stated by the Attorney General in your state. Their are a couple of options, depending how mad you are, and how bad you want to go after JK Harris. You can file a complaint in court that JK Harris filed false reports as to the debt owed, and ask for damages. You can also file papers in small claims court, asking for the maximum amount allowed by law. Name JK Harris as the defendant, and the sales person you met with as the codefendant. If that person is not there name another sales person. When you go to the hearing, ak for "Treble Damages", (3x's) the amount. Ste the reason for treble as to the lies, deception, non performance, etc. You will win, for doesn't appear. They still won't pay you, so after 30 days go backto court and get a "Capias", naming the sales person. You now have an arrst warrant, to drag their a*s intocourt an explain why they haven't paid you. Mail a copy (certified),to the sales office, and JK Harris, attention MOnica Linder, asking where it would be most convenient to arrest the person at home or work.Another option is to get a Writ of Execution, to attach JK's assets, but all the office equipment is leased, so the sheriff has to attach the cas as the customers pay. Either way you should get what the court awarded you. You can research all the proceedures for papers to file and proceedures on the internet for anything more than small claims.
