A class action lawsuit has been thrown out by Judge Ross on 10/1/10  non-compete clause 10/1/10 (St Louis franchisee Individual Taxes) d/b/a Jackson Hewitt Tax Service

According to the October 1, 2010 edition of the Post Dispatch Business Section, Individual Taxes d/b/a/ Jackson Hewitt has lost it's case against class action members seeking to have a non-compete clause within 2 years and a 25 mile radius of any person who has been employed by the franchisee. 

According to the article, former employee Mr. Hufford states that a monkey can prepare tax returns, and Judge Ross apparently agreed with him.  An attorney for the case, Mr. John Kress states that it is unfair to those who signed a non-compete because they then could not get a job. 

A past employee, Beverly Johnson reports that she could not find employment based on a 2 year - 25 mile radius non-compete clause signed during her employment.  Ms. Johnson states she lost her second husband, was foreclosed on and filed bankruptcy due to not being able to find gainful employment in her chosen field because of the clause.  Having a breach of contract filed against her by Individual Taxes d/b/a Jackson Hewitt for unproven breach-of-contract played heavily in her level of stress.

Individual Taxes d/b/a Jackson Hewitt - this is not the only lawsuit this franchise has had with regard to Breach of Contract.
