While at my Nieces home over the Thanksgiving holiday we were visiting a friend of hers at her friends home. While at her friends house my niece and her friend went into the back bedroom to smoke some marijuana, something that I do not condone. I chose to remain in the kitchen while they went and did there thing.

During that time I was told to help myself to something to eat if I would like. I decieded to help myself to a couple of slices of pumpkin bread and a glass of milk.

We left shortly after and went back to my nieces house were I started to feel funny. About that time the phone rang. It was my nieces friend. She was calling to ask my niece if I had eaten some of the pumpkin bread, to which I responded,yes. She then informed my niece that the pumpkin bread which I had eaten had marijuana baked into it.

Well that explained why I was starting to feel funny and remained feeling funny for several hours.

Well the following Monday after the holiday I was told I had to take a random drug test. Well needless to say I ailed the drug test. when Jacfobson got the results back they told me to get my belongings out of the truck. I was at that time in Fairfeild, TX., 500 miles from my home and was left to find my own way home qand found out the next day that they filed a report with DAC Services That I failed a drug test for THC.

Of course they did not add any of the details and now my DAC report has on it a positive drug screen plus I was fired for something in which I had absolutly no control over. It is like someone "slipped me a mickey" and now Jacobson Transportation has totally ruined my reputation along with DAC services by reporting this very private information to anyone who asks for it.

Dude, what are YOU doing hanging around with people wh would slip drugs to you without your knowledge?

Once you get a few arrests and a substantial criminal history, YOUR LIFE IS OVER!

My step sister got involved with drugs and her life went straight to hell.

She had GREAT job but she couldn't leave the cocaine alone!

She tripped out and she is serving time now. HEAVY time!

You need to get yourself a better class of friends or you will end up as an ex-con loser either in jail or waiting to go back to jail just like most of the people I knew who started using drugs and committing crime to keep the high going.

Company Did The Right Thing

First of all, I drove for Jacobson for over a yr....and was terminated, but I have nothing but good things to say about this company. Second, come on driver, I have been out here for too many yrs (22 yrs) and I have heard some lame excuses, but this one takes the Cake and Ice Cream too.

You need to be honest with ourself first ..... there is no way that you were tested and then fired without a second drug test (it's mandated by Federal Law.) Second, if you were feeling funny prior to allegdlly being told you had ate some weed (THC) why didn't you go see a doctor? Why did you not ask for the mandated second drug test to confirm the presence of drugs....the Doctor's that Jacobson use all know the law, you as a driver should have been up on the law.

The company fired you due to you having illegal drugs in your system!! Put yourself in the companies place....you own 500-600 trucks and employ over 1500 people, would you want a driver in one of your trucks after having tested + for a controlled drug?

By allowing you continue to drive their equipment, after having tested +, if you were to have wrecked or worse, killed an individual.....the company would have no excuse for allowing you too and therefore, they would of had to pay millions to the individual or family members....I really don't think your story would have flown over the heads of the jury....and the state could have of charged you with a felony crime....Jacobson di you a huge favor by terminating you.

If you really want to hire a lawyer and try to sue them.....I say go for it....but you will lose. I, as well as the jury, will be for the compnay....they kept a druggie off the highways and byways....and there is no way the jury would find in your favor.

Sure, you can find a lawyer who would be more than willing to take your money, knowing that there is no way you would ever be able to win...so go blow your money....and cry on your way out of the Courtroom.

Grow-up and be an adult...admit you have a drug problem and then you can start the long road to recovery!!!!

I too Drive for a living and have to agree with the last entry here. I find it VERY hard to beleive this claim. First As a truck driver for many years and knowing the way this all works as I have seen it many times with my co workers. First you take a DOT random test, If that test is "positive" then it is sent on for confirmation testing and levels. If this second test comes back as "confirmed" then the (MRO) will contact you BEFORE contacting the company, The MRO is a Medical Review Officer" he will ask you questions about what you have eaten, or been given by a doctor. This MRO will then take the info you provide him and then make a FINAL decision as to negative or positve and send that info to the company.

If he indeed indicates that you are positve the company will send you to see a SAP Doctor, this is a subtance abuse provider, this Provider will determine if you have a problem or if this was a one time deal or explainable.

Heres your problem driver, you will NEVER drive again until you have a SAP evaulation and adress the issue. As a fellow driver I hope the best for you BUT this report does not seem to be the whole entire story!!!!!

Advice for Carl, and info for Dave re second hand smoke

First, I want to correct Dave. You CANNOT test positive in a urinalysis test from second hand smoke exposure. This is a myth. There is an allowable THC level before you would test positive, to allow for foods that can cause a false positive. It simply doesn't happen.

Carl,

You have recourse. As far as your DAC report, you can add your 100 word statement as provided for under federal law.

I agree with Thomas, you need to be smart, and protect yourself from this kind of thing. This means cutting all ties with dopers.

If you are serious about defending your character and career, you have some hard choices to make. The first would be to confront this "friend" of your Niece an informing them of what happened to you and request they provide you with a signed notorized statement as to what they did, and that you did not knowingly consume any drugs. They need to specify they put the drugs in the bread.

If they fail to do this, you need to decide how serious you are about clearing your name. You would then have to go file a police report and criminal charges against your nieces friend, as well as a civil lawsuit. It's up to you.

You say that you tested positive on a drug test because you ate a pie laced with marijuana. I think that you are being less than honest and are pulling everyone's leg with your story.

You would have to mix such a large quantity of marijuana into a pie in order to test positive on a drug test that the pie would be inedible!

Tell the truth Carl... I think that the reason you failed that drug test was because you smoked marijuana with your niece's friends! You partook of the ganja during the Thanksgiving holiday, and got caught by your employer.

I for one, am glad to know that your former employer, Jacobson Transportation, is helping to protect the highways of our country from pothead truck drivers!

I do recall another Carl from Arkansas who was also a little on the "slow" side... Carl Childers from the Billy Bob Thornton film, "Sling Blade"... Mmmm Hmmm!

What are the terms of your employment contract?

Testing positive is not the same as consumption.

While you admit (here) that you consumed marijauna, it's possible to test positive from second hand smoke exposure.

Talk to a lawyer about a wrongful dismissal claim. The wording of your contract might be loose enough that you can get a settlement.

I look forward to the 2010 Winter Olympics. Every athlete that spends more than 5 minutes in Whistler Village is going to test positive for THC. Should be fun.

Do you get yourself a better set of relatives and acquaintances who have better personal habits and personal judgement? Do you simply avoid associating with all dopers all the time no matter who or where they are? Or do you shrug your shoulders and say it's not your fault as you sink into poverty?

I always faced a lot of employment competetion, starting with Englishmen imported in the 1970's. Now good jobs leave the USA for other countries, and anything worthwhile left in the USA will generate increasing competition amoungst wouldbe employees.

Company management does not want to get involved in sorting out your personal life, or anybody's personal life. The members of management responsible for directly managing you and your coworkers also have families to support, and so they do not want want to risk the wrath of their own superiors who might fire THEM for keeping you around after you failed a drug test.

Good luck. You will need it.
