We met with Jay, he represented that he will be a direct lender the project.
Represented that he will need to deposit for appraisal paperwork etc.
after the wire was sent he was just a lose cannon, no attorney from Atlas investments group has contacted us to date to indicate that they want to close this deal.
I have asked for the deposit back but I'm not getting a response
we made it clear in the agreement that he will return the deposit back if he doesn't close

Guys,
This is not about defaming or lying and skimming, the deal with East West Bank is well and alive, and you are not East West or related to East West..
We gave you a deposit for you to be a "Direct Lender" not to shlep us around, and leave us with hooks.
And just to avoid gray area i won't go with East West, however please return the funds i gave as deposit, as you guys didn't deliver. and our aggrement was that if you don't fund you return the deposit.
And yes, I signed it for Jack Safer, as he was the broker to Jay Frankovich

Mr Mittleman came to us looking for a 15 million dollar construction loan, which we delivered from East West Bank, of which Mr Mittleman circumvented us and flew out to CA to meet our banker. After it turned out Mr Mittleman could not match the money need to complete the project and it turned out he was skimming 3 million off the top of his over inflated construction budget to his company Fallview capital, both Atlas and East West decided to terminate our relationship with him due to Fraud.
