J Botts Remodeling started our master bath remodel 4 weeks ago and it became obvious that it was going to drag on for additional weeks. He has received more than half of the budget but to date he had not purchase or ordered the major items (vanity, tile and glass shower enclosure)  needed to complete the project.  When asked, he refused to give an itemised listing of expenses to date.   He refused to return the unknown balance of the money given so that I can get the job completed. 

Most days he arrived around 10 am, left frequently for more than an hour to purchase material (taking his only helper with him) and often left around 4 or 5 pm.  There was an additional week lost because he was ill.  We were sorry about his illness but he offered no plan B to ensure that the work would continue. He stated that all the delays were because of changes that I had requested but he was not able to clearly state what those requests were.  I had decided that we would not use pocket doors which had nothing to do with the construction in progress but rather would reduce the cost of material.

I had another contrator come look to see what it was going to take to complete the job.  At this time we have 5 adults sharing 1.5 bathrooms.   To my chagrin I was informed that after 4 weeks (3 so called work weeks) the shower is plumbed with the incorrect size of pipe. Two Moen faucet fixtures are installed instead of one faucet and one diverter and they are not installed correctly. The shower pan is in but not raised to the correct height.  The toilet has been relocated and the prior sunken tub has been filled in.  The wiring is done and the lights are in and there are about 5 pieces of the incorrect type of sheetrock for bathrooms on ceilng and one wall.  The relocation of the door from the bedroom has not happened.  And as previously stated none of the major items are purchased or ordered. I am almost at square one on my retirement gift to me.

It is becoming obvious that John Battalacola will not do the honerable thing and return funds that he is not intitled to for work he did not done.  It is also obvious that he is unwilling to consider that he has stolen from us.
