In April 2005, my husband and I went to JD Byrider as a last resort to get a much needed vehicle. We have a small child and so we chose a 1999 Dodge Grand Caravan which was the same price as a Caprice we also tried out. The van was great and at first we felt we got somewhat of a deal only paying $80 a week based on my husband getting paid weekly. However as we looked elsewhere we knew we were scammed. I immediately looked up the blue book value of our van and found that it was worth THREE TIMES LESS than what we were paying total. We were suckered into a loan for a max of $14,000 by the end of our loan period for a vehicle worth a max of $4000. This included NO long term warranty other than the 30 days. The vehicle had 97,000 miles on it and even after owning it for six months no one anywhere would take it as a trade in claiming it was worth WAY less than what we had left to pay on our loan. We've kept paying on the van and tried off and on to find a place that would take it as a trade in but as the mileage goes up (now 145,000) value goes down more and again we can't find a place willing to take it as a trade because now it is worth even less. Our biggest problem is not the vehicle..although it has always had a leaky seal in the transmission which doesnt give us a whole lot of trouble. The breaks have on going problems which we fix and had looked at by JD Byrider a month after buying the van and wich they NEVER fixed and claimed they never had a part for. We have never gone to them to get the van fixed at all. At any rate, our issue is mostly with their loan department CNAC.
At the time we bought the vehicle my husband made more a week and we have never had a problem other than one bad few weeks way in the beginning. We pay CNAC like clockwork only asking a few times to dip into what credit we have built up to pay a smaller payment if something comes up. ($30 less). Our biggest issue is that we pay bi weekly now and honestly sometimes one of us is ill from work or some emergency comes up and although we owe bi weekly, they pay by the end of the month the whole amount to JD Byrider. Yet, they refuse to let us pay how we want to (we dont like our account being controlled by their payments) when we want to as long as the total payment comes in the end of the month. It is all by their rules and they REFUSE to work with us so basically we pay...and we starve or dont get to work because we cant fill the gas tank. We even tried to refinance which they claimed after 2yrs we could do. They refuse and said they don't do that and we have to go to a bank. We have tried every bank around and no one will because we owe more than the van is worth. It is almost as if JD Byrider and CNAC cornered us and tricked us into this loan claiming even with bad credit they could help. They suckered us into believing they could help when all they have done is mess up the chances we have had to get ahead. All they did positive ...if its really a positive thing, is give us a vehicle. Mind you its a vehicle that will be worth nothing by the time its paid off, thanks to selfish dirty money hungry b*st*rds like JD Byrider and CNAC.

WHY DID YOU AGREE TO THIS DEAL IF IT WAS SUCH A BAD DEAL? WHY DID YOU WAIT & RESEARCH THE BLUE BOOK VALUE OF THE VEHICLE AFTER YOU BOUGHT IT. WOULDNT IT HAVE BEEN SMART TO DO THE RESEARCH BEFORE YOU BOUGHT IT. YOU SAID "honestly sometimes one of us is ill from work or some emergency comes up " HOW OFTEN DO YOU GET SICK AND OR HAVE AN EMERGENCY? YOU SAID "At the time we bought the vehicle my husband made more a week and we have never had a problem other than one bad few weeks way in the beginning." HOW MUCH LESS DOES HE MAKE? AT ANY RATE, ANY LENDER YOU USE EXPECTS YOU TO PREPARE TO KEEP YOU LOAN PAYMENT. WHY DIDNT YOU TELL THEM IN THE BEGINNING THAT YOU MIGHT NOT MAKE THE SAME KIND OF MONEY & IF YOUR INCOME CHANGED, THAT YOU WOULD TRY TO THEN DICTATE TERMS? IF ITS OK FOR YOU TO DEMAND TO PAY LESS, WOULD IT HAVE BEEN OK FOR THEM TO HAVE DEMANDED THAT YOU PAY MORE THAN AGREED WHEN YOU WERE MAKING MORE? YOU DID SAY "Yet, they refuse to let us pay how we want to (we dont like our account being controlled by their payments)" WHY DIDNT YOU DEMAND TO CONTROL THE PAYMENTS AT THE BEGINNING? OH THATS RIGHT, YOU WERE DESPERATE & SIGNED WHATEVER THEY PUT IN FRONT OF YOU & DIDNT SHOP AROUND OR NEGOTIATE, BUT ITS ALL THE LENDERS FAULT, RIGHT??

Thanks Michael for that comment. I wasn't sure however if we could still do all that you suggested. We have 1 more year left to pay. Should we pay it, shut up and take the loss or not? My husband is calling CNAC and setting them straight as far as us having to choose between feeding our child and paying a payment. I refuse to make a choice like that and I know he won't.

As far as the vehicle goes, we need it. The only reason we would give it back is because we know in the end it will be an anchor tied at our ankles when we try to sell it or trade it in. Also, my husband has decided he does not want our savings account bothered with payments anymore. We want control and he plans to tell them its either we mail them the money or they don't get it.

If we had less time on the loan I would fight to give the vehicle back but all we want is to be treated fairly and to be allowed to have control of when and how we pay as long as it is paid each month. We have had businesses screw with us in the past with automatic withdrawl and lost a checking account that way because someone decided to take money when they were not supposed to.

CNAC has been giving us written account ledgers on payments made each month but our loan never seems to drop much. The interest is ridiculous and in normal loans which i have had before, interest went down as the loan got further paid off...I was called and the loan was refinanced when I got down to less than half owed. We plan to ask them why they think they don't have to do that when every other loan place does. We got the run around when we asked the last person who took care of our loan. Someone else took over without us even knowing and shes worse than the last guy. Do you think we should speak to a lawyer?

The "JD" in JD Byrider stands for "Junk Dealer" as you are now finding out. I would walk, take the bus, grab a taxi, whatever before I went to a JD Byrider dealership. Or any dealership that has "buy here, pay here". You know you are going to get screwed at one of those dealerships.

JD's contracts always have something wrong with them. Close your account as you are no doubt allowing the payments to be debited automatically from your checking account. This is crazy! Never give these vultures your personal banking information. They are going to take whatever amount they feel like whenever they feel like. SO CLOSE YOUR ACCOUNT NOW!! ALso you will want to place a fraud alert on your credit. Then take the vehicle back to the dealership and tell them to unwind the deal. You're going to have to be bull headed because these a-holes are going to be bull headed. Don't believe their BS. Just leave the vehicle there and tell them you don't want it.

Oh, keep every piece of paper you got from the dealership. Don't give it back to them. JD is sleazy and will try to screw you even more by changing and forging paperwork to make it look like you are the bad guy. Should this go to court anyway.

By playing hardball with them you should be able to walk away relatively unscathed. If so, consider this a lesson learned and NEVER go to a JD Byrider dealership again!
