     I am 44 years old, a single father with 3 minor children.  I am their sole support.  We live in a mobile home park.  I am disabled and receive SSI.  My wife, at the time, and I purchased a car from J.D.ByRider.  The salesman asked a lot of questions, excused himself, and when he returned he said"there was only one car on the lot we qualified for, a 1995 Astro Van with 129,448 miles".  He did not offer a test drive.  He suggested we use the Chevrolet rebate of $230.00 for the down payment and he gave us a 24.99 APR.  Unfortunately we did not understand he was talking about and did not ask questions.  We were deserate for transportation and the salesman said "sign here".  We did, and walked out owing $13,143.74.

     After making 3 payments of $307.47 each, I realized I couldn't afford the van.  I washed and waxed the Astro van and returned it to Byrider in the same shape it was in when it left the lot.  I believed I was through with J.D.Byrider.  Not true, not true.  I thought I was signing a car loan contract, instead I was given a "buy it here, pay it here" open end loan.

     I bought the Astro Van on 8/28/2003.  CNAC took out a default judgement.  As of May 31, 2014, I was told they would accept $2,500.00 from me and $2,500 from my exwife.  I do not believe we owe them anything.

     I believe JD Byrider is selling substandard vehicles at inflated prices.

     J.D.Byrider and CNAC are blocking me from getting a home loan from HUD.

     A recent letter from this Division attests that only 3 complaints have been received each year since 2010.  In 2014 mine is the only complaint. In 2006 the Attorney General of Kentucky filed a class action suit on behalf of 14,400 people.  J.D.Byrider settled the lawsuit and was ordered to pay customers $7.1 Million. Washing and waxing a vehicle does not negate the terms of a sales contract.

“CNAC took out a default judgement.”

That statement makes no sense. A judge issued the default judgment because you failed to appear in civil court.

“I do not believe we owe them anything.”

The civil court judge doesn’t agree with that.

“J.D.Byrider and CNAC are blocking me from getting a home loan from HUD.”

Your credit history is preventing you from getting a loan.

“If you live in Michigan and you too have been scammed by J.D.Byrider, please join me in a Class Action Suit.”

You have already lost your case in court.
