JD Byrider - CNAC Ripoff and violator of Consumer Protection Laws (FDCPA) Mesa Arizona
I have been dealing with CNAC since I purchased a 1997 Ford Escort for $6000.00, a car that when I traded it was only worth $1500.00. I traded this vehicle on March 25,2004 to Sun Pontiac. Sun Pontiac was to have paid this loan in full. I recieved various collection calls after the car was traded, they wanted me to pay for a car that I no longer owned, nor was driving.
The collection practice they used are in violation to the Fair Debt Collection Practices Act. The account manager (JEFF) was rude and very very unprofessional. I traded my car to Sun Pontiac, and then the threatening collection calls started. On 05/04/04 I advised the caller that he was violating the FDCPA, I then hung up.
He called back twice more to harrass me. I did file a complaint against him and this was disregarded. On the date that I filed this complaint, I went into the office to make a payment. I advised the Customer Service Rep on duty of the situation and he took notes.
I then left the building with my receipt under the impression that it would be handled. I then returned to the building, because I had a question about my reciept. I over heard Jeff and this CSR talk about my complaint. The CSR was over heard saying that I was an idiot and he disregarded my complaint and threw it away. I then rung the bell to ask my question, and advised the csr that I would file a complaint against him as well, he then started to cuss at me, then Jeff came out and threatened me. I then left the building.
I called the next day to speak to the manager of this office and he refused to speak to me. When I traded the car to Sun Pontiac, Jeff called me a piece of s**t and hung up. I filed a complaint with CNAC-JD Byrider Corp and nothing was done.

sorry, what you posted is a REBUTTAL and not a new Rip-off Report.

Well now, I was served with a civil notice from Bartolini Fianance Corp aka JD Byrider/ CNAC from Mesa, AZ. The same clowns that sold me that pos car....They are claiming that I owe them $4,000+ dollars and That I VIOLATED Their contract. Well I filed a response to their complaint and a motion to dismiss on grounds that the courts have no jurisdiction under the federal arbitration act and that Bartolini waived their right to a trial. So I will have my day in court and I will not let these criminals get any money from me or my family. These idiots are trying to pin this debt any my fiancee saying that we are married and that I am a resident of Maricopa county as grounds for the lawsuit...what a joke. The funny thing of this whole matter is that the original Justice of the Peace who had jurisdiction recused himself...hummmmm I wonder why.... so this will be a fight and I will not let them abuse the courts on my watch..I can promise you that...If you have a problem with this company stand up for yourself...I promise that if we all get together and go against this corporation we can put them out of business..for good.. I had the pleasure to deal with a local company who sold cars in the same manner that Bartolini does business..now the owner is on the run for banking violations and he is out of business. this can be done, we just need to stick together...

You are in my area, Columbus, Ohio. I had a situation with JD Byrider on the East side. I purchased a 1997 Van there with deferred payments. I put down $900.00 and my deferred payments were $500.00 each. When it came time to pay my $500.00 (1st deferred payment), my mother became ill (she fell and broke her wrist, she lives out of state) and missed the due date. I had the van less than 30 days, my temps had not expired yet.
Anyhoo, when I returned back to Columbus from KY (where my mother lives in an assisted living facility), I went back to work on a Monday, only to find out that when I went to go home they had repoed my van. I had the money and called them to pay them but they said "no" that I couldn't have my van back and the deposit of $900.00 was non-refundable. Now I have no car, lost my job because I have no car, and have a repo on my credit report.
ANYTHING I CAN DO????? ANY HELP YOU CAN GIVE ME, IF ANY, WOULD BE APPRECIATED.

First do an on line complaint with the attorney General. Second- are you still in your deferred down payment period? If you are take the car back and get a refund. I used to be a manager there. It's not a done deal till you make your very first CONTRACTUAL payment. They want you to do that to lock you in the deal. Don't do it!! You got a piece of crap car. Respond if you need more help.
