I ordered 3 pallet of Walmart return toys base on emails and pictures going back and forth with my sales representative Dara Pettine of JD Closeouts. I was told I could not send credit card payment but had to send a Wire Transfer (now after reading the different posts I see why). I wired the funds to the company who in turn shipped three pallets to me outside The United States. Once the items arrived, I was sorely disappointed as the pallets were not filled with the toys and pictures conveyed by Dara. But rather dirty, smelly teddy bears(lots of them), broken toys, a hocky/pool table that is covered in cat hair, and outdated boxes of items.

I immediately contacted Dara via email and never got a response until I engaged the BBB. They did their best but the company stop responding to them as well and I am out of $3,000 in cost of goods, duties and shipping. I believe, this company needs to be stopped and sued and all those like myself should be able to recover our funds. I expected these toys for Christmas 2013 but was not able to sell one. My store lost this Christmas instead of making any profit. I believe because they were exporting outside The United States they sent the nastiest and most dirty items as to think they cannot be shipped back. The items are so bad they cannot be donated.

Can your company help me sue this company or maybe all of the folks who have been hurt by this company can come together. I am a small business in The Bahamas and lost like this is felt. Are there any lawyers who will take this company on?

Hi,

The offer they extend was the same via BBB. I then responded back to them agreeing to send the items back if they will provide their FedEx account number, or prove that they will secure the necessary costs to send the items back. I told them then and I still stand by it, I want my money back because I no longer have confidence in this company to honor their word nor trust what they will send.  I have told J D Closeouts in order to send those items back from my country, they would need to provide a US broker to process items on their side.

I don't feel after being out of $3K that I need to pay anything to send the items back. Since I had sent the response there was no response to absorb all export costs. I am aware of my legal options concerning this company. However, I have closed this chapter in my business book after not getting any response to absorb cost. It is a lost and a learning experience. I now know to do my research on the company prior to wiring funds and always pay via credit card.

Re: Nikisha Evans

Dear Sirs,

We are in receipt of your correspondence dated January 15, 2014 regarding our client Nikisha Evans. Ms. Evans was invoiced for returns toys and was explained that returns means potentially used or damaged items. She was sent sample pictures of loads and told that they were only sample pictures for her to see the type of items she would receive. She was never promised anything specific or with a manifest.

She was shipped a mix of toys that included new toys, returns and shelf pulls. Some things were damaged, as originally explained and other return items were in good condition. She received multiple big items on each pallet, including toy pool tables and 7 in 1 sets. Her pallets had high value on them.

If she is not satisfied with her merchandise, even though it was exactly what she ordered, we will be more than happy to exchange the merchandise for her for a different lot. She would need to ship the pallets back and we will exchange them for a different type of merchandise, having the same value as her pallets. We will waive the restocking fee for her to help out even more.
