I feel compelled to file a complaint against AccessAffiliates.com. I am seeking the return of $2,000 deposited with that company in the anticipation of conducting business with Mr. Jessy Brancato, who was to act as our affiliate manager.

 

It had been planned to begin an affiliate program in 2013. There were delays in getting extra software developed especially for the affiliate program and the payment service we were using at that time.

 

Relations with Mr. Brancato were excellent and it appeared as if he was trustworthy. As a result, I had no qualms about paying his company $1,000 of two occasions, the agreed monthly fee if they had been recruiting affiliates and managing the program. Because of the delay in development of the software addition they required, to my knowledge no work was actually carried out by Mr. Brancato, other than communications with me.

 

Programming delays ran into the Christmas period and cost far more than expected. This ultimately led me to postpone the affiliate program for many months and then indefinitely. I asked for the return of our deposit twice and received no reply. Jessy Brancato has also ignored his local Better Business Bureau and now, apparently, a debt collection agency.

 

I had expected to eventually go ahead with the affiliate program through this firm, but once trust is lost it cannot be rebuilt. Anyone considering doing business with Jessy Brancato should refuse to pay any money up-front.

Mr Sydney, A reply was sent to you clearly dening your request for a refund. Which is the reason why you were upset. At the end of the day, we continuously made changes to accommodated your requests, but it is not our fault that you couldn't find qualified staff to implement the changes. The solution to this was simple all you had to communicate was something along the lines of "Hey Guy's, Thank you for being so flexible despite the fact that there's an agreement in place. However, at this very moment I need to further postpone the program until further notice" Not: Jump on the phone for 2 hours telling me about a mixture of personal things and life in Panama, to then finalize the conversation with "I would like to be refunded" Regarding any third party attempts to communicate were most likely handled by someone else as that would not be my department. The same would apply to the gentleman who called me and at one point even said he was a lawyer.(a man who wears many hats) Note: Please excuse me if I don't reply in a timely manner as I have a conference call to join with a client in India.

Let's talk facts: Did you require software I could not get written? Yes. Failure to get that done was not your fault or mine.

What was the contract for: getting affiliates or talking. We did a lot of talking; there were no affiliates nor was there an attempt to get them because of the software issue.

Was the contract for talking? It was not.

Did you do anything that helped my business? No, but that was not your fault or mine; circumstances were against that.

Did you answer any of my emails after I said I could not go ahead? No, not one.

Were the first of those requests impolite? The first, not the later ones when I was more than a little annoyed.

When I could not get you to respond, did you respond to the Better Business Bureau? I am not aware that you did.

What about the debt collection agency. Same story.

Is it reasonable that anyone would go to this much bother if he did not feel a complaint was fully justified?

I do not care whether you rebut what I have said. That is up to you. As I said earlier I have no time to waste with you. Your ethics leave a bad taste in my mouth.

 Mr Sydney, Well I disagree I think you know the truth but you don't want to accept it. Clearly the thruth is not the issue. You not accepting it is the issue. Agreements don't run only on your terms. I don't have to be "Big Enough" to suck it up. Why? Because you failed to comply and proceed as agreed? It seems that from past responses you constantly preach about "Trust".... How trustworthy are you Mr Sydney? I ask based on the fact that you backed away from an agreement and then ventured here to make a false claim based on your failure to comply.... Let me be clear I am not the type to run from a report nor be intimmidated. I am very accessible and all my information is publically available to anyone. You stated it took you 15 months to grab my attention. Well I guarantee you it would of been much sooner if I would have been notified on the day it took action. And no I don't want anything to go away or anywhere for that matter. Lastly, you want me to return the money to make this go away? Mr Sydney, make what go away? I'm replying because you reached out to me not because of any other reason. You called my name, here I am.

We both know the truth and it is not worth my time the keep batting this issue back and forth. The accusation stays. I have a squeaky clean reputation within my own succissful company and better things by far to do that argue with someone who does not count. I am glad that after 15 months I have your attention. You want this to go away? Pay the $2,000 back. It is not the money. It covers just a tiny fraction of my monthly payroll; it is the principal of the thing. Returning the money is what I would have done right off the bat. But that's me; obviously you are not big enough to suck it up. Enjoy yourself!

Mr Sydney, Clearly you admit the hold backs on your end. 1. How would it be possible to recruit affiliates and manage them, if there's no platform nor product to provide them? 2. The "Trust" started declining due to Mr Sydney requesting a refund months after the agreement was signed. However months prior according to Mr Sydney, the proposed changes were being worked on in order to launch the program. It was communicated to Mr Sydney numerous times that a refund was not possible. However, we would definitely move forward with the affiliate program as agreed. Fraud: wrongful criminal deception intended to result in personal gain. (There were no gains from this due to the structure of the program. As per your request it was based on performance. The $2,000USD fee was a company set fee) Theft: the action or crime of stealing. ( Clearly this never took place) As for attempting to intimidate future clients by using the terms "Buyer Beware" I will say the following since January 2015 I have launched two new OPM firms totaling 61 clients in multiple categories. In addition, 4 of those clients rank TOP 10 in ShareaSale, 9 TOP 10 in CJ, and 3 TOP 10 in LinkShare. Not one complaint nor any type of negative feedback. Why? Because my clients know what they want to achieve and are willing to improve and adjust to change if needed to be. As an added bonus Mr Sydney my personal record and credibility is spotless. Actually, I currently own and operate the biggest and most reputable mobile concealed weapon class company in central Florida approved by the NRA and the Department of Agriculture Division of Licensing. "Buyer Beware" has absolutely no relevancy to me as I don't sell anything to anyone. And every new client is referred to me. Upon there own decision to move forward they are not buying into anything, instead we are partnering to meet the goals and expectations.

I fully agree with the evidence Mr Brancato displays. In fact, I stated in my original complaint: "Relations with Mr. Brancato were excellent and it appeared as if he was trustworthy. As a result, I had no qualms about paying his company $1,000 of two occasions, the agreed monthly fee if they had been recruiting affiliates and managing the program."

Unfortunately, he betrayed that trust. Here are some other facts. There were numerous emails sent to Mr. Brancato that went unanswered. That began the lack of trust. Then I complained to the local Board of Trade (of which he was not a member). Then I handed the issue over to debt collectors. Nothing happened there either. Disgusted, I moved on with my life. A person who sells his honor for $2,000 is not worth wasting time over.

It has taken 15 months to get this man's attention. Now he is getting more from others. That is what he deserves. Buyer beware! Pay nothing up front to this man.

After this length of time, Mr. Brancato's memory is "questionable". I consider what he did to be a ripoff. There was a total lack of communication to several emails when I called a halt to the project. Yes, earlier, there had been good communication. Mr. Brancato can squirm all he wants. He knows whether he is an upstanding business person or not. I now run a very successful business - one Brancato could have profited from - so I have no furhter time to waste on people like him. I have moved on; he is stuck with himself.

Firstly I would like to apologize for not replying sooner however, I was made aware of this report recently. When I was introduced to Mr Sydney we engaged in a very long conversation mostly pertaining about his personal life and his finances as well as, other personal details which I will not disclose here. After multiple Skype calls, phone calls, and emails Mr Sydney, decides he will move forward with the affiliate program. (Note: I dedicated over 1 month of work and personal time to Mr Sydney at no expense to him) Upon Mr Sydney request to move forward an Agreement was sent to him at a discounted amount totalling $2,000USD. In addition, I recall the following words from Mr Sydney Tremayne "Before I pay this money I want you to know I borrowed it from my ex wife, we have a great relationship to this day. Please make this program work" My response was: Understood, however I can not guarantee success but I will guarantee you that I will devote my self and do my very best. We both agreed. Shortly after as mentioned by Sydney Tremayne delays due to his team in Panama started to set the launch of the affiliate program back. Such as; 1. "The guy working on my project, informed me he can no longer continue to work" 2. "The person working in the shopping cart has stopped working" 3. "I'm trying to find someone to continue the work" When I asked, why? Sydney's response was "I have exhausted the budget to pay them and they have been working for free" I as well as, AccessAffiliates tried everything in our power to assist and accommodate Mr Sydney Tremayne. From adjusting our price, postponing the start date, making my self available Monday - Sunday, providing personal phone number, allocating resources and staff, and the list goes on... The company even made an exception to ignore the agreement start date and make it effective when Mr Sydney Tremayne felt comfortable and ready. Mr Sydney Tremayne, signed an agreement and decided to terminate such, based on personal reasons. Yet, in addition wants a refund? Finally, Mr Sydney Tremayne was never ignored, I in fact upon learning that Sydney requested a refund consulted with upper management and the request was declined. The option offered to Mr Sydney Tremayne was to continued as agreed. I am confident a copy of the actual agreement would be disclosed if requested legally.
