I won the bid on a tapestry on Overstock Auctions on Oct 2 and paid for it via Pay Pal on Oct 3 from seller "wwwjlrockencom" aka Jim Lakin. After 2 weeks of no delivery of the item, I contacted the seller. He advised me that it was not in stock and it would take 4-6 weeks to deliver. He did not mention that on the auction site and per Overstock, it is against their policy to sell what you don't actually have.

I requested a refund from the seller and he refused. He then reported me as a Non-Paying Bidder to Overstock and I then had to prove that I paid through Pay Pal. I left negative feedback on his site and in turn, he left viscous, nasty feedback on mine advising all sellers to retract my bids.

I reported Jim Lakin and his company to both Overstock and Pay Pal in hopes of getting my money back. Since I was not having any luck with him, my husband got involved and began e-mailing him. Then the name calling and mud slinging from Jim Lakin got even more nasty. Lakin also told my husband that I requested a special color; however, on the bid site it clearly stated to choose either black or red -- I chose black, not a special color. Lakin then wrote to my husband that he "BURNED ME" and I was not getting my money back.

Both Overstock Auctions and Pay Pal are actively pursing him as I write this. Although the item was relatively inexpensive, and the shipping cost was even more than the tapesty itself, the matter of principle has taken over. You just can't rip consumers off and get away scott-free.

Admitting that he "Burned Me" has got to be one of the dumbest "dumb-crook" stories I have read. Obviously, this will be used against him when appropriate authorities are contacted.

Take Him to Small Claims Court

Gigi, in my opinion, after watching a lot of the TV court shows, you should take him to small claims court. If you still have that email, you have a huge chance of winning your claim. Just be sure to print it out so you can show it to the judge. Also, print out all the other ones where he has been abusive.

I'm particularly impressed with Judge Alex and Judge Marilyn Milian. They don't allow nonsense in their court.

I am surprised PayPal hasn't acted on this by now. From what I have read and understand, people, who have been reported for unsavory practices, have not only just had their PayPal accounts frozen, but also their bank accounts. You can read many such reports on www.PayPalsucks.com .

Best to you and here's believing you will win. Principle is what is at stake here, but he also needs to be shown he can't get away with ripping off people.

He admitted to you, IN WRITING, that he "burned" you.

Reading the negative feedback he leaves when people complain of not receiving their orders, it makes you wonder what he's REALLY angry about. How dare buyers send him money and expect to receive their orders in a timely manner!!

The man has more stories than Mother Goose.
