Dear JLW Builders (Jamie Pace) (Jason warlyk)
We are writing to inform you that we will be taking further legal action against Jamie Pace the builder and JLW builders if we do not receive our two- ten warranty that is stated in the contract (no other warranty substitute) within two weeks of this letter or if a settlement or resolution is not made.

We have an appointment with an attorney on fort McPherson in two weeks from the date of this letter who is ready to take action on our part. We have spoken to Jamie Pace numerous times in person and on the phone since the closing of September 17th 2007 to the present time about the warranty. We keep hearing excuses or the favorite phrase two weeks.

Mr. Pace had once stated to my wife at closing that the warranty would be in the mail in two weeks. Later two weeks became three weeks, four weeks, months and so on. Later after harassing Mr. Pace between my wife and I myself being overseas calling him Mr. Pace stated to my wife that he would have to put up an amount of 10,000 dollars for the warranty company to hold for 2 to 3 years in order for him to get the warranty.

Later Mr. Pace came to us to inform us that he and Jason Warwick will give us 750.00 dollars or something to that affect to settle the warranty issue. I told my wife not to except the offer and to let Mr. Pace and Jason know that we want the warranty. My wife and I have left several messages since last week to discuss this matter with Mr. Pace and still have not received a phone call in return.

My wife left a message in particular on Mr. Pace cell phone explaining to him to give her a call to discuss this matter further because she did not want to mess up the client builder relationship that she thought she had with Mr. Jamie Pace and she wanted going to court to be the last option. So this letter should not be a surprise to Mr. Pace.

My wife and I have also discussed with Mr. Jamie Pace about other issues with the house since September 17th 2007 to the present and I was told while on leave before going back overseas that the problems would be fixed. I am yet still waiting for the problems to be fixed. Enclosed you will find a list of the issues that my wife and I are still waiting to be fixed.

In conclusion I must say that I am very disappointed with Mr. Pace and JLW Builders! Not only do I have to worry about my work being in the United States Army overseas fighting for our country, I also have to worry about my family going through issues that should have been resolved a long time ago.

My wife felt that she could trust Mr. Jamie pace and JLW builders and it upsets me to see her hurt by this situation. Again you have two weeks from the date of this letter to resolve this issue or I will guarantee you will see my wife on my behalf or me in court!

Handrails installed needs to be stained
Iron spindles need to be tightened
Remove paint from my silk curtains
Remove stains from columns on fireplace mantle
Finish floors properly in dining room
Go over steps to cover nail holes
Remove paint off of my hardwood floors
Paint patches left from repair and holes in the walls left by contractors
Painters were suppose to come and touch up the walls because some of the walls you can see the white wall behind it.
Repair hardwoods that are splitting
Repair cracks in the molding
Please, Please fix the squeaks in my floor
The guy came out to fix the waterline in the basement said that he needed to come back to finish the job (he never did)
Valve on the basement wall needs to be covered
Need a screen for the kitchen window
On each side of the front door needs to be caulked or whatever Jamie called it.
The rubber needs to be fixed up under the door
Lastly our 2-10 Warranty

Dear Mr. Warlick:
This letter is written on behalf of my client, SGT Brown, in my capacity as legal assistance attorney at Fort McPherson, Georgia, regarding your failure to complete warranty work at their home and to provide a 2-10 Warranty in accordance with their purchase agreement.
My client purchased his home from you on September 17, 2007. Since that time, he has made numerous attempts to get you to provide the 2-10 warranty as required in the contract. Paragraph 7 (Special Stipulations) of the purchase agreement specifically states that you would provide a 2-10 Warranty. To date, you have not done so. SGT Brown would not have purchased this house without such a warranty. This warranty was a condition of the purchase of this house and you are legally required to provide it. Based on assertions from you contractor, Jamie Pace, my client believes that you are ineligible to obtain this warranty because of prior business acts with the company that provides the warranty. Regardless of the reason you have not done so, this letter serves as an immediate demand for the warranty. Failure on your part to do so within 10 days of receipt of this notice will leave my clients no choice but to take legal action against you.

Additionally, numerous attempts to get you to make repairs have also gone unanswered. Not only have my client's phone calls been unanswered, certified mail has been returned unclaimed. Your actions demonstrate a disregard for your duty of repair to my client. My client has previously provided you a list of the needed repairs. In case you have not received the list, I have enclosed another one for your review along with pictures that demonstrate the state of disrepair of this house.

This is a new house. It is unconscionable to have these kinds of problems in a new house. As a builder, I am sure that you take pride in your work. This house is a reflection of your business and your business practices, and we demand that you immediately correct any issues covered by your one year warranty. I have assured my client that once these issues are brought to your attention, you would correct them promptly.

SGT Brown would like to settle this matter amicably. He has been more than patient with you. Our country is at war and being stationed overseas, these problems create an undue burden on his family. However, if the warranty is not provided immediately and the repairs are not made, I have advised him on the appropriate court action.
