Complaint Review: JMS Savannah/Jim Fah

JMS Builder Owned by Jim Fah - misrepresentation ..a man of no word Rip off the amount of $ 750.34 upon closing of the escrow.

Last October we made a deposit for the purchased of new homes called Savannah homes located in the City of Riverside which is being built by JMS Builder and owned by Jim Fah. The builder gave us a $ 6,000 Incentives Credit to buyers towards buyers non-recurring closing cost and / or upgrades, options through builder or thru Interior designs.

Last November 2000 I called up the builder named Jim Fah regarding the $ 6,000.00 credit which I discussed to him the situation of the closing cost, the price match up of the washer and dryer from outside store and also an adjustment to the purchased price in case of the excess amount of the credit incentives towards closing cost.

He mentioned to me that he never match up the store prices due to additional manpower to do the job. As to reducing the price of the home is not good also. With the situation that I had discussed with him on our $ 6,000 credit, he told me that Don't worry, you will get the full amount of $ 6,000.00 credit no matter what.

Last February 28th, 2001 we had the walk thru and the escrow company called us up on the same day of our walk thru to close the escrow on the same day. Everything they done to us on that were on the last minutes and rush. Upon closing the escrow, the builder only credited us the amount of $ 5,249.66

Instead of $6,000.00. So, I called the Jim Fah, the builder and asked for the refund of $ 750.34 or give us the washer and dryer for the difference of the remaining balance of the $6,000.00 Credit. After so many days trying to reach him and asked him to give us what is due to us, he told me that he will not give us any. Now the builder doesn't want to give us the $ 750.34. I told the builder that he does misrepresentation and a man of no word.

Furthermore, Right now we are very uncomfortable living in the new homes because of the construction going on was kids cannot play and we cannot open the windows because of the dusts and noises.

Our homes is besides the next house under construction and our half of our side yard is being occupied by the builder and we cannot do our improvements right now because of the construction of next to us. How considerate we are with the builder, but in return he doesn't want to give us the amount due to us.

The builder does misrepresentation and broke his word of promised to us. I would like to ask if you can help to collect the amount that the builder owed us. Can I asked for damages on the construction going on the house next to us where the kids cannot play and we can not do yet our improvements because half of our side yard were being used by the builder.
